Common use of Summary of Entitlement Clause in Contracts

Summary of Entitlement. A2 Under the NES Parental Leave provisions, an employee is entitled to take parental leave if the employee:- • has worked for the employer for at least twelve (12) months before the date of birth, the date of adoption; or when the leave starts (if the leave is taken after another person cares for the child or takes parental leave); and • has, or will have, responsibility for the care of a child. There is no obligation to work an additional twelve (12) months, before an employee can take another period of parental leave. The NES Parental Leave provisions apply when:- • an employee gives birth; • an employee’s spouse / partner gives birth; • an employee adopts a child under sixteen (16) years of age. Parental leave is for a twelve (12) month period. However, an employee may elect to extend their period of parental leave by an additional twelve (12) months. In combination, the maximum period of parental leave that an employee would be entitled to is twenty - four (24) months. Concurrent leave; where both persons take leave at the same time is allowed. The minimum period of time for concurrent leave is two (2) weeks and the maximum period of time is eight (8) weeks.
