Two-way communication shall only be between these two persons so as to prevent any miscommunications and to maintain control of the project scope, schedule, and budget. If Contractor, in the course of performing prosecuting the Work, finds any discrepancy between this Contract and the physical conditions of the locality, or any errors, omissions, or discrepancies in this Contract, it shall be Contractor’s duty to immediately inform Consultant, in writing, and Consultant will promptly review the same. Any Work done after such discovery, until authorized, will be done at Contractor’s sole risk, without entitlement to reimbursement or compensation. 14.5. Contractor shall supervise and direct the Work competently and efficiently, devoting such attention thereto and applying such skills and expertise as may be necessary to perform the Work in accordance with this Contract. Contractor shall be solely responsible for the means, methods, techniques, sequences, and procedures of construction.

SUPERINTENDENCE AND SUPERVISION. ‌ 14.1The Design-Build Firm shall keep the Contract under his own control and it shall be its responsibility to see that the Work is properly supervised and carried on faithfully and efficiently. The superintendent shall not be changed except with the written consent of ConsultantProject Manager, unless the superintendent proves to be unsatisfactory to Contractor Design-Build Firm and ceases to be in its employ. All information shall be recorded in the daily log in indelible ink, unless otherwise approved by Consultant. In which case, CONTRACTOR shall immediately notify CA upon the Project Manager’s dismissal in writing with identification of CONTRACTOR’s replacement Project Manager. The superintendent CONTRACTOR’s Project Manager shall represent Contractor; CONTRACTOR and all instructions direction given to the superintendent CONTRACTOR’s Project Manager shall be as binding as if given to Contractor, CONTRACTOR and will be confirmed in writing by Consultant upon the written request of Contractor. The daily log shall be kept on or accessible from the Project site and shall be available at all times for inspection and copying by County CA, CPM or Consultant. Copies of daily logs must be maintained electronically unless otherwise required by the CPM. Contractor 3.5.4 CONTRACTOR shall supervise and direct the Work competently and efficiently, devoting such attention thereto and applying such skills and expertise as may be necessary to perform the Work in accordance with this Contractthe Contract Documents. Contractor CONTRACTOR shall be solely responsible for the means, methods, techniques, sequences, and procedures procedures, safety of construction, and BCAD security compliance.

The Designated Representative must be satisfactory able to Consultantcommunicative effectively and be onsite a minimum of eight (8) hours per day, Monday through Friday (excluding holidays), and when any work or deliveries are occurring. The superintendent Designated Representative shall not be changed except with the written consent of Consultantthe Project Manager, unless the superintendent Designated Representative proves to be unsatisfactory to the Contractor and ceases to be in its employ. All information shall be recorded in the daily log in ink, unless otherwise approved by ConsultantProject site. The daily log shall be kept on or accessible from available for inspection by the Project site and shall be available Manager at all times during the Project.
