SUPPLIER REQUEST FOR INCREASE OF THE FRAMEWORK PRICES. 5.1 The Supplier may request an increase in all or part of the Framework Prices in accordance with the remaining provisions of this paragraph 5 subject always to:
5.1.1 the Supplier's request being submitted in writing at least three (3) Months before the effective date for the proposed increase in the relevant Framework Prices ("Review Adjustment Date") which shall be subject to paragraph 5.2;
5.1.2 the Approval of the Authority which shall be granted in the Authority’s sole discretion.
5.2 The earliest Review Adjustment Date will be the first (1st) Working Day following the [first (1st)] anniversary of the Framework Commencement Date. Thereafter any subsequent increase to any of the Framework Prices in accordance with this paragraph 5 shall not occur before the anniversary of the previous Review Adjustment Date during the Framework Period.
5.3 To make a request for an increase in some or all of the Framework Prices in accordance with this paragraph 5, the Supplier shall provide the Authority with:
5.3.1 a list of the Framework Prices it wishes to review;
5.3.2 for each of the Framework Prices under review, written evidence of the justification for the requested increase including:
(a) a breakdown of the profit and cost components that comprise the relevant Framework Price;
(b) details of the movement in the different identified cost components of the relevant Framework Price;
(c) reasons for the movement in the different identified cost components of the relevant Framework Price;
(d) evidence that the Supplier has attempted to mitigate against the increase in the relevant cost components; and
(e) evidence that the Supplier’s profit component of the relevant Framework Price is no greater than that applying to Framework Prices using the same pricing mechanism as at the Framework Commencement Date.
