System Construction. All transmission lines, equipment and structures shall be so installed and located as to cause minimum interference with the rights and reasonable convenience of property owners and at all times shall be kept and maintained in a safe, adequate and substantial condition, and in good order and repair. The Grantee shall, at all times, employ ordinary care and use commonly accepted methods and devices for preventing failures and accidents which are likely to cause damage, injuries, or nuisances to the public. Suitable barricades, flags, lights, flares or other devices shall be used at such times and places as are reasonably required for the safety of all members of the public. Any poles or other fixtures placed in any public way by the Grantee shall be placed in such a manner as not to interfere with the usual travel on such public way.
System Construction. Lessee shall within a reasonable period of time, but not later than six (6) months after the FCC grant of digital authority for the ITFS Channels, purchase equipment such as the antenna, waveguide or transmitters specified on the authorization for the ITFS Channels. At Lessee's expense, Lessee shall purchase and install such transmitters, transmission line, modulators, antennas and other equipment as required to operate the ITFS Channels in accordance with the provision of such authorization. Any equipment so used in such construction shall be leased to lessor pursuant to Paragraph 5 hereof. Such equipment is hereinafter referred to as the "Leased Equipment". Lessee shall retain title to the Leased Equipment except as noted by Paragraph 15 herein.

(a) Within two (2) years from the date of the award of the initial franchise, the Grantee must make cable television service available to every dwelling unit within the initial service area. (1) The Grantee must make cable television service available to at least twenty (20) percent of the dwelling units within the initial service area within six (6) months from the date of the award of the franchise. (2) The Grantee must make cable television service available to at least fifty (50) percent of the dwelling units within the initial service area within one (1) year from the date or the award of the franchise. (b) The Grantee, in its application if any, may propose a timetable of construction which will make cable television service available in the initial service area sooner than the above minimum requirements, in which case the said schedule will be made part of the franchise agreement, and will be binding upon the Grantee. (c) Any delay beyond the terms of this timetable, unless specifically approved by the Village, will be considered a violation of this chapter for which the provisions of either Sections 37 or 46 shall apply, as determined by the Village. (d) In special circumstances the Village can waive one hundred (100) percent completion within the two (2) year time frame provided substantial completion is accomplished within allotted time frame, substantial completion construed to be not less than ninety-five (95) percent and justification for less than one hundred (100) percent must be submitted subject to the satisfaction of the Village.

System Construction. Any work which requires the disturbance of any street or interfere with traffic shall be undertaken with prior permission from City; in accordance with the City’s generally-applicable permitting process. No poles, underground conduits or other wire-holding structures shall be erected by Grantee without prior approval of the appropriate City official through established permit procedures. Grantee shall have the right to attach its wires to existing poles owned by City or an agency of City without payment of an additional annual rental fees to City provided Grantee shall pay in advance for all costs of rearrangement of existing wires to achieve clearances as specified by the National Electric Safety Code. All structures, lines and equipment erected by Grantee shall be located as to cause minimum interference with public ways and places and for property owners who adjoin said public ways and places. Poles and other structures of public utilities which may be available to Grantee shall be used to the extent practicable to minimize interference with pedestrian and vehicular travel.

In accordance with the requirements of Article 2 of this Agreement, the Contractor shall carry out the delivery of equipment as well as its installation, setting, commissioning and configuration, until the system is fully operational. At the time of delivery of the equipment to the relevant location, the Contractor shall be provided with a key to the premises where the equipment is to be installed. The Contractor shall return the key to the Client when the ▇▇▇ report is signed. In the period between the time of delivery of the equipment to the relevant location and until the signing of the ▇▇▇ report, which only the Contractor shall have access to the relevant location. If the Contractor fails to successfully conduct individual ▇▇▇ in the second try the Contractor must return the key to the Client. This does not relieve the Contractor from his contractual obligations related to the responsibility over the active equipment, as the Client must be able to proceed with other works in the AAN container.
