Common use of Technical Deficiencies Clause in Contracts

Technical Deficiencies. There are, and since January 1, 2019, there have been, no bugs, errors or defects (collectively, “Technical Deficiencies”) in any of the commercially available Company Services that would prevent or have prevented the same from performing substantially in accordance with their published specifications or user documentation other than Technical Deficiencies that have been resolved in the ordinary course.
