Common use of Term and Commencement Date Clause in Contracts

Term and Commencement Date. The term and Commencement Date of this Lease are as specified in Sections 1.9 and 1.10. The Commencement Date set forth in Section 1.10 is an estimated Commencement Date. Subject to the limitations contained in Section 3.3 below, the actual Commencement Date shall be the date possession of the Premises is tendered to Tenant in accordance with Section 3.4 below; provided, however, that the Commencement Date shall not occur prior to the date set forth in Section 1.10. If the actual Commencement Date does not occur on the first day of a calendar month, the term of this Lease shall be extended by the number of days between the actual Commencement Date and the first day of the next calendar month, it being the intention of Landlord and Tenant that the term of the Lease end on the last day of a calendar month. When the actual Commencement Date is established by Landlord, Landlord shall complete the letter attached here to as Exhibit B and Tenant shall within five (5) days after L▇▇▇▇▇▇▇'s request, execute the letter and deliver it to Landlord. T▇▇▇▇▇'s failure to execute the letter within said five (5) day period shall constitute T▇▇▇▇▇'s acknowledgment of the truth of the facts contained in the letter delivered by Landlord to Tenant.
