Term and Commencement. Unless sooner terminated as provided herein, the Term of this Lease shall be for that period set forth in Item 8 of the Basic Lease Provisions, as the same may be extended in accordance with any option or options to extend the Term granted herein, and shall commence (the “Commencement Date”) on the date that is the earlier to occur of (i) seven (7) days following the date of Landlord's execution of this Lease (as evidenced by the date located immediately below Landlord's signature on this Lease), or (ii) the date Tenant commences occupancy of all or a part of the Premises for the conduct of business. When the actual Commencement Date has occurred, ▇▇▇▇▇▇ shall execute a Commencement Date Memorandum in the form shown in Exhibit B (the “Commencement Date Memorandum”) as provided by Landlord within five (5) days after ▇▇▇▇▇▇▇▇’s request therefore. Tenant’s failure to execute the Commencement Date Memorandum within said five (5) day period shall, at Landlord’s option, be an Event of Default hereunder and shall constitute Tenant’s acknowledgment of the truth of the facts contained in the Commencement Date Memorandum delivered by Landlord to Tenant.

Term and Commencement. Unless sooner terminated as provided herein, the Term (a) The term of this Lease shall be for that period set forth in Item 8 Forty-Four (44) months, commencing on February 1, 1999 (the "Commencement Date") and expiring at noon on September 30, 2002 (the "Expiration Date"), unless the same shall sooner terminate pursuant to any of the Basic terms, covenants, conditions or agreements of this Lease Provisions, as or pursuant to law.
(b) Landlord shall not be liable to Tenant if Landlord cannot deliver possession of the same may be extended Demised Premises on the Commencement Date due to the holding over by a prior tenant in accordance with any option or options to extend violation of the Term granted hereinterms of said prior tenant's lease. This Lease shall continue, and shall commence (rent will be waived for the “period between the Commencement Date”) on Date and the date on which Landlord delivers possession. Notwithstanding the foregoing, in the event that Landlord is unable to deliver possession of the earlier Demised Premises on or before February 15, 1999, then in such event, Tenant may serve notice on Lessor of its intention to occur of (i) terminate this Lease and if within seven (7) days following thereafter, Landlord shall not have delivered possession of the date of Landlord's execution of Demised Premises, then in such events, this Lease shall terminate on the expiration of such seven (as evidenced by the date located immediately below Landlord's signature on this Lease), or (ii) the date Tenant commences occupancy of all or a part of the Premises for the conduct of business.
