Common use of Terminal Access and Services Charge Clause in Contracts

Terminal Access and Services Charge. The parties agree that a monthly terminal access and services charge in the amount of $50,000 (“Monthly Services Charge”) shall be billed each month to ALON with respect to monitoring, control, reporting and other services to be provided to ALON at the Refined Product Terminals pursuant to this Agreement. The Monthly Services Charge (without consideration of any previous adjustments pursuant to this Section 3(f)) shall be adjusted on March 1 of each Contract Year commencing on or after January 2006 by an amount equal to the percentage increase, if any, in the PPI from the month of December 2004 to the month of December immediately preceding such Contract Year; provided, however, the Monthly Services Charge will not decrease as a result of any decrease in the PPI.
