Common use of Termination After Novation Clause in Contracts

Termination After Novation. After the Novation Effective Date the Material Project Contractor will only be entitled to exercise its rights of termination under the Material Contract: (a) in respect of any [Project Co Event of Default] [NTD: Use term in Material Contract] arising after that date in accordance with the Material Contract; or (b) if the Proposed Substitute does not discharge the obligations and liabilities assumed by it under Section 4.6 which relate to matters arising prior to the end of the Step-in Period within 15 Business Days following the Novation Effective Date.
