Termination of Route Segment. In addition to, and not in limitation of, any rights set forth in the Agreement, any Route Segment may be terminated by Crown Castle without liability (unless due to a default by Crown Castle under any applicable Underlying Rights agreement), upon reasonable notice to Licensee, to the extent Crown Castle is no longer authorized under the Underlying Rights to install, construct, maintain, operate, or convey the license to use the Cable or other property as contemplated by the Agreement. If a Route Segment is terminated pursuant to this Section, Crown Castle shall make reasonable efforts to find alternate capacity or facilities owned or controlled by Crown Castle to meet Licensee’s needs, but under no circumstances shall Crown Castle be obligated to contract for or to construct new
Termination of Route Segment. In addition to, and not in limitation of, any rights set forth in the Agreement, any Route Segment may be terminated by Company without liability (unless due to a default by Company under any applicable Underlying Rights agreement), upon reasonable notice to Licensee, to the extent Company is no longer authorized under the Underlying Rights to install, construct, maintain, operate, or convey the license to use the Cable or other property as contemplated by the Agreement. If a Route Segment is terminated pursuant to this Section, Company shall make reasonable efforts to find alternate capacity or facilities owned or controlled by Company to meet Licensee’s needs, but under no circumstances shall Company be obligated to contract for or to construct new facilities, or otherwise incur any additional cost or expenses, to replace the Cable or Licensee Fibers on the Route Segments terminated under this Section 5.1.
Termination of Route Segment. Any Route Segment may be terminated:
(i) by NU upon reasonable notice for the purposes of providing safe and economical electrical service; or
(ii) by NECOM upon five days prior written notice if two Cable failures per month for three consecutive months occur on a Route Segment as a result of NU's electric operations and NU fails to take steps to cure such failure with due diligence, unless NU shall have cured such failure prior to the expiration of said five day period, or where cure is not possible within said five day period, NU is proceeding to cure with due diligence.
(iii) by NU at any time after consultation with NECOM if it cannot obtain the regulatory approvals needed by it to perform its obligations under this Agreement with respect to such Route Segment or can obtain them but on terms that are unduly burdensome on NU.
Termination of Route Segment. Any Route Segment may be terminated:
(i) by Grantor upon reasonable notice for the purposes of providing safe and economical electrical service; or Confidential Materials omitted and filed separately with the Securities and Exchange Commission. Asterisks denote omissions.
(ii) by Grantee upon five days' prior written notice if two Cable failures per month for three consecutive months occur on a Route Segment as a result of Grantor's electric operations and Grantor fails to take steps to cure such failure with due diligence, unless Grantor shall have cured such failure prior to the expiration of said five day period, or where cure is not possible within said five day period, Grantor is proceeding to cure with due diligence.
(iii) by the Grantor at any time after consultation with Grantee if it cannot obtain the regulatory approvals needed by it to perform its obligations under this Agreement with respect to such Route Segment or can obtain them but on terms that are unduly burdensome on the Grantor.
Termination of Route Segment. Any Route Segment may be terminated:
(i) by Niagara Mohawk upon reasonable notice if it is required to do so in order to provide or continue to provide a safe and reliable electric transmission system; or to maintain Niagara Mohawk’s property rights and licenses, permits or similar rights associated with Niagara Mohawk’s Electric Transmission Poles providing such service despite Niagara Mohawk’s reasonable efforts to maintain both its property rights or permits and the Route Segments,
(ii) by Niagara Mohawk at any time if it cannot obtain the regulatory approvals needed by it to perform its obligations under this Agreement with respect to such Route Segment or can obtain them but only on terms that are unacceptable or unreasonably burdensome on Niagara Mohawk.
(iii) by Licensee at any time provided Licensee gives thirty (30) days prior notice to Niagara Mohawk and removes the Licensee System along the Route and restores the Property in accordance with section 10.
Termination of Route Segment. Any Route Segment may be terminated:
(i) by Grantor upon reasonable notice for the purposes of providing safe and economical electrical service; or
(ii) by Grantee upon five days’ prior written notice if two Cable failures per month for three consecutive months occur on a Route Segment as a result of Grantor’s electric operations and Grantor fails to take steps to cure such failure with due diligence, unless Grantor shall have cured such failure prior to the expiration of said five day period, or where cure is not possible within said five day period, Grantor is proceeding to cure with due diligence.
(iii) by the Grantor at any time after consultation with Grantee if it cannot obtain the regulatory approvals needed by it to perform its obligations under this Agreement with respect to such Route Segment or can obtain them but on terms that are unduly burdensome on the Grantor.

(iii) by NU at any time after consultation with NEON Optica if it cannot obtain the regulatory approvals needed by it to perform its obligations under this Agreement with respect to such Route Segment or can obtain them but on terms that are unduly burdensome on NU.
Termination of Route Segment. Any Route Segment may be terminated:
(i) by National Grid upon reasonable notice if it is required to do so in order to provide or continue to provide a safe and reliable electric transmission system; or to maintain National Grid’s property rights and licenses, permits or similar rights associated with National Grid’s Electric Transmission Poles providing such service despite National Grid’s reasonable efforts to maintain both its property rights or permits and the Route Segments, (ii) by National Grid at any time if it cannot obtain the regulatory approvals needed by it to perform its obligations under this Agreement with respect to such Route Segment or can obtain them but only on terms that are unacceptable or unreasonably burdensome on National Grid.
(iii) by Licensee at any time provided Licensee gives thirty (30) days prior notice to National Grid and removes the Licensee System along the Route and restores the Property in accordance with section 10.
Termination of Route Segment. If a Route Segment is terminated pursuant to Section 5.1, Provider shall make reasonable efforts to find alternate capacity or facilities owned or controlled by Provider to meet Customer’s needs, but, under no circumstances shall Provider be obligated to contract for or to construct new facilities, or otherwise incur any additional cost or expenses, to replace the Cable or Customer Fibers on the Route Segments terminated under Section 5.1.
Termination of Route Segment. In addition to, and not in limitation of, any rights set forth in the Agreement, any Route Segment may be terminated by Planet without liability (unless due to a default by Planet under any applicable Underlying Rights agreement), upon reasonable notice to Licensee, to the extent Planet is no longer authorized under the Underlying Rights to install, construct, maintain, operate, or convey the license to use the Cable or other property as contemplated by the Agreement. If a Route Segment is terminated pursuant to this Section, Planet shall make reasonable efforts to find alternate capacity or facilities owned or controlled by Planet to meet Licensee’s needs, but under no circumstances shall Planet be obligated to contract for or to construct new
