Testing of Material. 3.1 Samples of materials required for testing shall be provided free of charge by the contractor. The cost of tests shall be borne by the contractor in the manner indicated below: (All expenditure to be incurred for testing of samples e.g. packing sealing, transportation, loading, unloading etc. including testing charges shall be borne by the contractor. The NIT shall have list of approved laboratories for testing as approved by ADG.DG/MAN/410 dated 22/10/2021). a) All the test in field lab setup at construction site shall be carried out by the Engineering Staff deployed by the contractor which shall be 100% witnessed by JE & 50% of tests shall be witnessed by AE –in-charge. At least 10% of the tests are to be witnessed by the EE/ SE division office. b) All the entries in the registers will be made by the designated Engineering staff of the contractor and same should be regularly reviewed by JE/AE/EE/SE division office. c) Contractor shall be responsible for safe custody of all the test registers. d) Submission of copy of all test registers, materials at site Register and hindrance register along with each alternate Running Account Bill and Final Bill shall be mandatory. These registers should be duly checked by JE in Division Office & receipts of registers should also be acknowledged by Accounts Officer by signing the copies and register to confirm receipt in division office. e) Extensive testing of the materials used for construction is a pre- requisite for attaining high quality of the work. This shall also require specialized tests, physical, chemical, ultrasonic, x-ray and various other types of tests which cannot possibly be carried out in a site laboratory. These tests also require specialized personal who regularly deal in such testing. Therefore, the need arises for carrying out the tests in outside laboratories.

Testing of Material. (a) (i) A level Tests for works costing 100 Lakhs and above: The contractor shall set up site laboratory for testing of materials (except Sch ‘B’ materials) for ‘A’ level tests as listed in Appendix ‘A’ hereto. The contractor shall arrange all equipment/ machines for the tests specified in Appendix ‘A’ as A level tests at his own cost with prior approval of AGE (I). This cost shall be included in the lump sum costs quoted by the contractor. The contractor shall employ a competent technical representative as approved by the AGE (I) for the purpose of testing and all such tests shall be carried out in the presence of Engineer-in- Charge. The successful tests results thereof shall be recorded and signed jointly by the contractor and the Engineer-in-Charge. The charges for these tests i.e. A level tests carried out in site laboratory of the contractor shall not be recovered. In case the contractor has not set up the site laboratory and the tests are carried out in zonal or any other laboratory setup/ approved by AGE(I), the recovery shall be made at rates applicable i.e as given in Appendix ‘A’. (a) (ii) A level Tests for works costing upto 100 Lakhs: The contractor may set up site laboratory at his option for works costing upto 100 lakhs. The other stipulations will be same as specified in preceding para (aa) (i). However in case the contractor has not set up the site laboratory and tests are carried out in zonal or any other laboratory approved/ setup by AGE (I), the recovery shall be made at rates applicable i.e. as given in Appendix ‘A’.

Testing of Material. Prior to shipment of any Material from any given production lot by Supplier, [***] or its affiliate or such other testing facility as may be designated by Verrica to Supplier in writing from time to time (the “Testing Facility”) shall be permitted to take samples from such lot. Such samples shall be in such amounts and taken in such manner as may be specified by Verrica and shall not be deducted from the quantity of Material to be delivered to Verrica under any given Purchase Order. Such samples shall be subjected to such tests as may be specified by Verrica to the Testing Facility in order to reasonably verify that the Materials from such lot meet the Material Specifications. In the event the samples are found not to meet the Material Specifications, then such Material shall be deemed to have been rejected by Verrica in accordance with Section 2.5.4 and Supplier shall not ship to Verrica any Material from such lot without Verrica’s prior written consent. In the event the samples are found to meet the Material Specifications, then Verrica shall authorize Supplier to ship Material from such lot to Verrica as and when set forth in any applicable Purchase Order. The fees and expenses of the Testing Facility shall be borne entirely by Verrica.

Testing of Material. Profiling, assay or other analysis of the chemical or physical constituents or characteristics of the Material shall be conducted by Metamining Nevada in accordance with best management practices, in compliance with all Laws and shall be described in reasonable detail in the Approved Material Management Plan. Metamining Nevada shall promptly provide to Metawise accurate and complete copies of all laboratory data and other reports that it receives or generates in connection with such analytical activities.

  • Review of Materials During the term of this Agreement, Client shall ensure that all prospectuses, statements of additional information, registration statements, proxy statements, reports to shareholders, advertising and sales literature or other materials prepared for distribution to Fund shareholders or the public, which refer to the Subadviser in any way, prepared by employees or agents of Client or its affiliates are consistent with information previously provided by Subadviser. Subadviser shall promptly notify the Client of any changes to information pertaining to the Subadviser and stated in the materials described in this Section 6(g).

  • Filing of Materials All records related to a grievance shall be filed separately from the personnel files of the employees.

  • Removal of Materials If you decide you would like to remove your Materials from the Service, you may provide written notice to Prime Publishing by either deleting the image through the Prime Publishing interface or by contacting Prime Publishing customer service, and Prime Publishing will remove such Materials from the Service within a reasonable period of time. 5) License for Name, Trademarks and Likenesses.   • Storage of Materials Borrower shall cause all materials supplied for or intended to be utilized in the construction of the Improvements but not affixed to or incorporated into the Property to be stored on the Property or at such other location as may be approved by Lender in writing, with adequate safeguards to prevent loss, theft, damage or commingling with other materials not intended to be utilized in the construction of the Improvements.
