Common use of TEXTING WHEN DRIVING Clause in Contracts

TEXTING WHEN DRIVING. (all contracts) In accordance with Executive Order 13513, "Federal Leadership on Reducing Text Messaging While Driving" (10/1/2009) and DOT Order 3902.10 “Text Messaging While Driving” (12/30/2009), FAA encourages recipients of Federal grant funds to adopt and enforce safety policies that decrease crashes by distracted drivers, including policies to ban text messaging while driving when performing work related to a grant or sub-grant. The Contractor must promote policies and initiatives for employees and other work personnel that decrease crashes by distracted drivers, including policies to ban text messaging while driving. The Contractor must include these policies in each third party subcontract involved on this project. This Agreement is made this day of , 2019 by and between the CITY OF EL PASO, a municipal corporation organized and existing under the laws of the State of Texas, hereinafter referred to as the “Owner”, and PROFESSIONAL SERVICE INDUSTRIES, INC., a Texas Corporation, hereinafter referred to as the “Consultant”.
