Third Party Hardware. Customer may choose to purchase third-party hardware from Lunchbox (“Hardware”). Subject to Customer’s payment of all applicable fees, Lunchbox will supply any Hardware specified in a Service Order. Lunchbox does not warrant or provide support for Hardware, whether or not such Hardware is designated by Lunchbox as “recommended,” “certi fied,” or otherwise. Lunchbox is not responsible for any violations of Applicable Law relating to the Hardware, or arising from Customer’s use of the Hardware. Title and risk of loss in the Hardware passes t o Customer upon Lunchbox’s delivery to the shipping carrier.
Third Party Hardware. Third Party Hardware costs, if any, are invoiced upon delivery.
Third Party Hardware. We will sell, deliver, and install onsite the Third Party Hardware, if you have purchased any, for the price set forth in the Investment Summary. Those amounts are payable in accordance with our Invoicing and Payment Policy.
Third Party Hardware. GE warrants Hardware manufactured by third parties including, but not limited to, personal computers, gateways, routers, servers, sensors, edge devices, micro drives, rotary disks, compact flash, cables and accessories, and embedded third party firmware only to the extent that the manufacturer's or third party’s warranty allows GE to transfer such warranty to Customer. GE shall pass through to Customer any such warranties. Except to the extent any such manufacturer or third party provides a pass-through warranty, such Hardware is provided “AS IS” without warranty of any kind and the manufacturers and/or third parties disclaim all warranties, whether express or implied, including but not limited to the implied warranties of merchantability, title, non-infringement, or fitness for a particular purpose. The manufacturers or third parties shall not have any liability for special, indirect, punitive, incidental, or consequential damages. Customer's sole remedy for breach of such warranty shall be the remedy offered by and available from the manufacturer or third party, if any. GE shall have no liability, whether in contract, tort, negligence, or otherwise, to Customer with respect to third party Hardware and associated Embedded Software. The remedies stated in this Section 4.3 are Customer’s exclusive remedy, and GE’s sole obligation and liability, for any breach of the warranties for Hardware.
Third Party Hardware. 7.1 Tech Data will procure for the Customer the Third Party Hardware in the Quantity specified in an Order.
7.2 Tech Data will use commercially reasonable endeavour to deliver the Third Party Hardware in the Quantity specified in an Order to the Third Party Hardware Delivery Address on the Delivery Date.
7.3 If the Delivery Date of the Third Party Hardware falls on a day that is not a Business Day, then the Delivery Date will be the next Business Day.
7.4 Notwithstanding 7.2, Tech Data is not responsible for any delay in the delivery of the Third Party Hardware, and any consequence of that delay, to the extent that the delay is caused by the Customer or any other third party, or a Force Majeure Event.
7.5 If after placing an Order, the Customer wishes the Third Party Hardware to be delivered to a location other than the Delivery Address, it must make a request in writing to Tech Data no later than thirty days (or such other period as is agreed between the Parties) prior to the Delivery Date. Tech Data may in its sole discretion, determine whether to agree to such a request and what conditions are to apply if it agrees to such a request.
7.6 The Customer must notify Tech Data within 3 Business Days after delivery of any Third Party Hardware, if there is a shortfall in the quantity delivered or any damage to the Third Party Hardware (or any part thereof) at the time of delivery. If the Customer does notify Tech Data within the timeframe set out before, the Customer is deemed to have accepted the Third Party Hardware.
7.7 Unless otherwise specified in an Order, the Fees for the Third Party Hardware do not include a training fee. Tech Data will provide training in the use of the Third Party Hardware if separately ordered by the Customer in an Order. Such training may be subject to separate Fees and additional terms and conditions as set out in an Order.
Third Party Hardware. Hardware that is not part of a Humanetics Device is delivered “AS IS” and is covered by the warranty offered by the manufacturer or third-party vendor, if any. To the extent permitted by the manufacturer or third-party vendor, Humanetics assigns to Customer any applicable warranty rights to such Hardware, and Humanetics will use commercially reasonable efforts to provide information and assistance to enable Customer to make warranty claims against the manufacturer or third-party vendor for the Hardware. To the extent mandatory applicable law requires that Humanetics must provide warranty for the Hardware it has provided to Customer, the warranty provided by Humanetics is limited to the minimum warranties required by the applicable law and for the minimum term required by the applicable law.
Third Party Hardware. We will sell and deliver any Third-Party Hardware set forth in the Investment Summary for the price indicated therein. Unless otherwise indicated, installation of Third-Party Hardware will be performed by ▇▇▇▇▇ or identified third party installers.
Third Party Hardware. Hardware manufactured, published or provided by a third party, including the sensors, equipment, software, firmware, and data files embedded with in such Hardware and sold to the Customer by TrackX are provided on an “AS IS” basis without warranty by TrackX of any kind, either express or implied. Third party Hardware is not covered by any warranty provided by TrackX. TrackX agrees to pass through to Customer, to the extent available at no cost to TrackX, any manufacturers/publisher/supplier’s written warranties associated with third party Hardware purchased by Customer, provided, however, if TrackX agrees to provide any services in connection with passing through such warranties such services will be billed to Customer on a time and materials basis at TrackX’s then effective standard rate. Customer agrees that, TrackX has no liability for any claims arising out of any act or omission, including negligence, by the third party.
Third Party Hardware. Head Kraken intend to use third-party hardware (sensors, like heart rate monitor, breath sensor, eye tracker and others) on demand and following Trial User feedback.
Third Party Hardware. All use of Third-Party Hardware is at Customer’s own risk and is Customer’s responsibility.
