Third-Party Offerings. Dell may offer Third-Party Products for use with the APEX Service through an online marketplace, or using Dell’s then-current Third-Party Product resale programs (e.g. “Extended Technologies Complete”, “Software & Peripherals (S&P)”). Third-Party Products that Distributor orders from Dell through these resale programs are referred to as “Third-Party Offerings”. Third-Party Offerings. Subject to the terms of this Agreement and applicable Order Form, RADICL shall grant to Customer and its Users the right to access and use the Third-Party Offerings. Customer may be required to install on its Protected Machines certain agent-based software sensors (each, an “Sensor”) to obtain access to the Third-Party Offerings. Upon receipt of the Sensor from RADICL, Customer shall install the same on all the Protected Machines and notify RADICL of the same upon completion. Customer acknowledges that all Sensors are property of the applicable Third-Party Offerings service provider and Customer assumes all risk with regards to installation of the same on the Protected Machines. Customer shall not use any Third-Party Offerings in excess of or beyond the Subscription Term, the Order Form, and the Third-Party Offering Agreement (defined below). Third-Party Offerings are subject to the license terms and conditions identified in the applicable Order Form (“Third-Party Offering Agreement”), and Customer agrees that it shall comply, and it shall cause its Users to comply, with all such Third-Party Offering Agreements. For avoidance of doubt, all members of the Customer IT Team are required to comply with all Third-Party Offering Agreements.
Third-Party Offerings. Your acquisition or use of a Third Party Offering, and any exchange of data between You and any third party or the Third Party Offering, is solely between You and the applicable third party. We do not warrant or support Third Party Offerings. If You choose to use a Third Party Offering with the C3 AI Software, You grant Us permission to allow the Third Party Offering and its provider to access Customer Data as required for the interoperation of that Third Party Offering with the C3 AI Software. We are not responsible for any disclosure, modification, or deletion of Customer Data resulting from access by such Third Party Offering or its provider.

Your access to and use of any Third Party Offering, including any goods, services or information, is governed by the terms and conditions respecting such offerings. Third-Party Offerings. Certain uses of Software may allow Customer to evaluate and use third- party applications and/or services (“Third Party Offerings”). Customer’s use of Third Party Offerings will be governed by terms Customer must accept during the installation or registration process. Questions about the terms should be addressed directly to the Third Party Offering provider. Third Party Offerings may involve the exchange of data with the Software. Cisco is not responsible for Customer’s data outside of the Software or for modifications or deletions of Customer’s data made by third parties or their Third Party Offerings. If Customer has questions or concerns about the processing or handling of Customer’s data by Third Party Offering providers, Customer shall contact those providers directly. Customer bears all risks associated with using or relying upon Third Party Offerings. Cisco and the Third Party Offering provider do not warrant the accuracy, reliability, completeness, usefulness, non-infringement, or quality of any Third Party Offerings and hereby disclaim all express and implied warranties, including any implied warranties of merchantability or fitness for a particular purpose, relating to such Third Party Offerings. Cisco and the Third Party Offering provider shall not be liable or responsible in any way for any losses or damage of any kind, including lost profits or other indirect or consequential damages, relating to Customer’s use of or reliance upon any Third Party Offering.
