Common use of Third Party Performance Clause in Contracts

Third Party Performance. Notwithstanding any provision herein to the contrary, in the event that any portion of the Property is leased, sold or otherwise transferred to any third party, any jobs or capital investments made by said third party shall be counted toward the applicable incentive as described herein as if the Buyer had created the jobs or made the capital investment itself.
