Personnel Performance Clause Samples

The Personnel Performance clause sets standards and expectations for the quality and conduct of individuals assigned to perform work under a contract. It typically requires that personnel possess appropriate qualifications, experience, and skills, and may allow the client to request the replacement of underperforming or unsuitable staff. Personnel Performance. The Company shall enforce discipline and good order at all times among the Company's employees and all Subcontractors. All persons engaged by the Company for Design/Build Work shall have requisite skills for the tasks assigned. The Company shall employ or engage and compensate engineers and other consultants to perform all engineering and other services required for the Design/Build Work. All firms and personnel performing Design/Build Work, including Subcontractor firms and personnel, shall meet the licensing and certification requirements imposed by Applicable Law.

The Company shall replace any Company or Subcontractor employee or worker at the request of SRWA, after notice and a reasonable opportunity for corrective action, in the event SRWA determines, in its discretion, that such employee or worker does not have the requisite skills for the tasks assigned or has engaged is unlawful, unruly or objectionable conduct.
Personnel Performance. The DBOM Contractor shall enforce discipline and good order at all times among the DBOM Contractor’s employees and all Subcontractor employees. All persons engaged by the DBOM Contractor for Design-Build Work shall have requisite skills for the tasks assigned. The DBOM Contractor shall employ or engage and compensate engineers and other consultants to perform all engineering and other services required for the Contract Services. The DBOM Contractor shall ensure that all persons Board of Water Supply, City and County of Honolulu Kalaeloa Seawater Desalination Facility Design-Build-Operate-Maintain Project Service Agreement Article 5 - Management, Labor andSubcontractors ​ ​ performing Contract Services, including all Subcontractors, comply with all registration, licensing and certification requirements imposed by any Governmental Body or otherwise under Applicable Law, including DBOM Contractor and Subcontractor employees.

The Design-Builder shall ensure that all persons performing Contract Obligations, including all Subcontractors, comply with all registration, licensing and certification requirements imposed by any Governmental Body or otherwise under Applicable Law, including Design-Builder and Subcontractor employees.
Personnel Performance. The Lessee shall enforce discipline and good order at all ▇▇▇ es among the Lessee's em ployees and all Subcontractors. All persons engaged by the Lessee for ICI Design/ Build W ork shall have requisite skills for the tasks assigned. The Lessee shall employ or engage and compensate engineers, licensed surveyors and other consultants to perform all engineering and other services required for the ICI Design/Build Work. Each such engineer and consultant shall have a current professional registration or certification to practice in the State if required by Applicable Law.

  • School Performance The School shall achieve an accountability designation of Good Standing or Honor on each of the three sections of the Performance Framework. In the event the School is a party to a third party management contract which includes a deficit protection clause, the School shall be exempt from some or all measures within the financial portion of the Performance Framework. In accordance with Charter School Law, the Authorizer shall renew any charter in which the public charter school met all of the terms of its performance certificate at the time of renewal.

  • Work Performance ▇▇▇▇▇▇ agrees that all Services performed hereunder shall be performed on a best effort basis by employees, students, faculty, graduate assistants and staff having an appropriate experience and skill level and in compliance with the statement of work.

  • Contract Performance C19.1 The Contractor shall ensure that: C19.1.1 the Goods conform in all respects with the Specification and, where applicable, with any sample or performance demonstration approved by the Authority; C19.1.2 the Goods operate in accordance with the relevant technical specifications and correspond with the requirements of the Specification and any particulars specified in the Contract; C19.1.3 the Goods conform in all respects with all applicable Laws; and C19.1.4 the Goods are free from defects in design, materials and workmanship and are fit and sufficient for all the purposes for which such Goods are ordinarily used and for any particular purpose made known to the Contractor by the Authority.

  • Full Performance The Owner and the Contractor hereby agree to the full performance of the Contract Documents.

  • CONTRACTOR’S PERFORMANCE 2.21.1 Contractor shall make citizen satisfaction a priority in providing services under this Agreement. Contractor shall train its employees to be customer service-oriented and to positively and politely interact with citizens when performing contract services. Contractor’s employees shall be clean, courteous, efficient, and neat in appearance and committed to offering the highest quality of service to the public. If, in the Director’s opinion, Contractor is not interacting in a positive and polite manner with citizens, he or she shall direct Contractor to take all remedial steps to conform to these standards
