Timber. During the Diligence Period, but prior to the Lease Commencement Date, if Landlord desires to cut, clear, grub or otherwise remove any timber from the Land (collectively, “Timbering Activities”), Landlord shall first send a written request to Tenant, which request shall set forth the area of the Land in which Landlord intends to conduct such proposed Timbering Activities, and Landlord shall provide Tenant with any additional information which Tenant may reasonably request in connection with such proposed Timbering Activities. Landlord shall not proceed with any Timbering Activities unless and until Tenant has provided its prior written approval to such Timbering Activities, and if requested by Tenant, Landlord shall coordinate with Tenant at all times during such Timbering Activities and comply with any procedures, limitations or requirements which Tenant may impose in connection with such Timbering Activities. Following the Lease Commencement Date, Landlord shall not commence any Timbering Activities on or within the Premises and Landlord shall have no right or claim to any timber located therein, it being agreed that Tenant may remove any such timber and retain the proceeds from same.
