Time Waiver Sample Clauses

Time Waiver. The timely performance and observance of the parties’ obligations hereunder is an essential condition of this Agreement, and: (a) if the Licensor waives a particular default of the Licensee, that will not affect or impair the rights of the Licensor regarding any other default of the Licensee; (b) if the Licensor delays or fails to exercise any rights in connection with a default of the Licensee, that will not affect or impair the rights of the Licensor regarding that event or any other default of the Licensee; and (c) in any event, the timely performance and observance by the Licensee of its obligations will continue to be an essential condition of this Agreement without the need for specific reinstatement following particular waivers, extensions, or delays.

Time Waiver. The timely performance and observance of the parties’ obligations set out in these Terms of Use is an essential condition and: (a) if the Province waives a particular default of the Institution, that will not affect or impair the rights of the Province regarding any other default of the Institution; (b) if the Province delays or fails to exercise any rights in connection with a default of the Institution, that will not affect or impair the rights of the Province regarding that event of any other default of the Institution; and (c) in any event, the timely performance and observance by the Institution of its obligations will continue to be an essential condition without the need for specific reinstatement following particular waivers, extensions, or delays.

Time Waiver. Time is of the essence in this Agreement. No waiver or any default or breach by ▇▇▇▇▇▇▇▇ hereunder shall be implied form any omission by the County to take action on account of such default other than the default specified in the waiver. Such waiver shall be in writing and shall be operative only for the time and to the extent therein stated.

Time Waiver. Pursuant to Section 7.20(a)(i) of the Loan Agreement, Obligors have failed to maintain minimum Consolidated EBITDA of no less than $20,000,000 for the 12 month period ending on June 30, 2002.

Time Waiver. The time limits herein specified shall be calculated by excluding Saturdays, Sundays and holidays. Time limits may be waived by mutual agreement. Grievances submitted dealing with a Notice of Intent to Discipline are to be filed within 5 work days and will be adjudicated according to the steps detailed in Article 17 Section 6.

Time Waiver. Time is of the essence hereof. No waiver by the Owner of any particular default or omission committed by the User shall affect or impair the rights of the Owner in respect of any subsequent default or omission of the same or of a different kind.

Time Waiver. 6.01 Time will be of the essence of this Agreement. 6.02 No waiver of or neglect to enforce any right or remedy of the Lender upon the happening of an Event of Default will be deemed a waiver of the said right or remedy upon the happening of any subsequent Event of Default.
