Tooling Equipment. In the event that any tooling equipment is needed for the manufacturing, sterilizing and packaging solely of the Products (the "Tooling Equipment"), Arthrex shall, at its sale discretion, either pay for such Tooling Equipment or reimburse Bovie for the purchase of such Tooling Equipment at Bovie's 'purchase price including any discounts, rebates or other purchase price reductions to which Bovie is entitled; provided, that Arthrex shall consent in writing to the need for any Tooling Equipment prior to the purchase or order thereof. Any such Tooling Equipment shall be and remain the sole property of Arthrex. Bovie shall reimburse A1ihrex for any damage to the Tooling Equipment that exceeds the normal wear and tear of such Tooling Equipment or was caused by the abuse or misuse of such Tooling Equipment by Bovie, its Representatives or the representatives of any contract facility engaged by Bovie.
Tooling Equipment. Except as expressly set forth below in this Subsection, and except in cases where tooling or modifications to tooling are requested by IBM, LSI shall, [*], supply and do all things necessary, including, without limitation, supply all tooling and equipment required for the manufacture and testing of the Product. Tooling Equipment. Solectron further agrees that with respect to all Tooling & Equipment provided by Trimble and subject to this Agreement, Solectron will:
Tooling Equipment. 14.1 All designs, materials and equipment finished to DPI by HP or paid for by HP in connection with this agreement (collectively "HP Property") shall: a) Be clearly marked or tagged as property of HP; b) Be subject to inspection by HP at any time during normal business hours; c) Be used only in filling releases from HP; d) Be kept reasonably separate from other materials, tools, or property of DPI or held by DPI; e) Not he modified in any manner by DPI without prior agreement by HP; f) Have periodic maintenance performed by DPI; and g) Be kept free of liens and encumbrances which may arise due to actions of DPI. 14.2 In the event HP is willing to release any equipment or tools for DPI's use during this agreement, the parties shall execute a separate Equipment Loan Agreement. 14.3 DPI agrees that persons operating HP Property will be fully trained in the proper use thereof.   • Metering Equipment 13.01. Utility will furnish, install, own and maintain metering equipment capable of measuring the flow of kilowatt-hours (kWh) of energy. The Customer's service associated with the CRG will be metered at a single metering point. The metering equipment will measure energy delivered by Utility to Customer and also measure energy delivered by Customer to Utility. Customer agrees to provide safe and reasonable access to the premises for installation of this equipment and its future maintenance or removal.

  • Furniture, Fixtures and Equipment Licensee acknowledges receipt in good condition of the Premises, without warranty, expressed or implied, on its condition or fitness. Licensee shall not alter the Premises’ fixtures, furnishings or equipment without consent of the Institute. Upon expiration or revocation of this License Contract, Licensee shall return the Premises, with Institute’s furniture, fixtures and equipment to Institute in the same condition as when received, less reasonable wear and tear. Licensee waives California Civil Code Section 1957, if applicable.

  • Leased Equipment The risk of loss or damage to leased equipment, goods or property shall not transfer to the University except as provided in §680.219, Florida Statutes. Any security interest in the leased equipment, goods or property granted to the Contractor contrary to AGO 79-72 and AGO 80-9 is null and void. Limitations of remedies provisions, which are unconscionable under applicable Florida law, are void. MATERIAL SAFETY DATA SHEET (MSDS). In compliance with Florida Statutes, Ch. 442, a Material Safety Data Sheet (MSDS) must accompany any applicable item delivered under this Agreement.

  • Stored equipment We accept no responsibility for any stored equipment or other property brought on to or left at the premises, and all liability for loss or damage is hereby excluded. All equipment and other property (other than stored equipment) must be removed at the end of each hiring or we will charge fees each day or part of a day at the hire fee per hiring until the same is removed. We may, in our discretion, dispose of any items referred to below by sale or otherwise on such terms and conditions as we think fit, and charge you any costs we incur in storing and selling or otherwise disposing of the same, in any of the following circumstances: (i) your failure either to pay any charges in respect of stored equipment due and payable or to remove the same within seven days after the agreed storage period has ended (ii) your failure to dispose of any property brought on to the premises for the purposes of the hiring.

  • New Equipment Where new types of equipment and/or operations, for which rates of pay are not established by this Agreement, are put into use after the ratification date of this Agreement within operations covered by this Agreement, rates governing such operations shall be subject to negotiations between the parties. This paragraph shall apply to all new types of equipment including office and clerical equipment. In the event an agreement cannot be reached within sixty (60) days after the date such equipment is put into use, the matter may shall be submitted to the National Grievance Committee for final disposition. Rates agreed upon or awarded shall be effective as of the date equipment is put to use
