Common use of Transfer Mechanism Clause in Contracts

Transfer Mechanism. Matterport shall not transfer the Data outside of the EEA (or transferred onward to another non-EEA location) unless it has taken such measures as are necessary to ensure the transfer is in compliance with Applicable Data Protection Law. Without prejudice to the foregoing, Customer consents to transfers outside of the EEA where Matterport has implemented a transfer solution compliant with Applicable Data Protection Law, which for example may include: (a) where such transfer is subject to an adequacy decision by the European Commission;
