Common use of Transfer of Data Clause in Contracts

Transfer of Data. 14.1 In the event of expiry or termination of this Agreement Service Provider shall cease to use the Bank’s Data and, at the request of the Bank, shall destroy all such copies of the Bank’s Data then in its possession to the extent specified by the Bank. 14.2 Except where, pursuant to paragraph 14.1 above, the Bank has instructed Service Provider to destroy such Bank’s Data as is held and controlled by Service Provider, 1 (one) months prior to expiry or within 1 (one) month of termination of this Agreement, Service Provider shall deliver to the Bank: (1) An inventory of the Bank’s Data held and controlled by Service Provider, plus any other data required to support the Services; and/or (2) a draft plan for the transfer of the Bank’s Data held and controlled by Service Provider and any other available data to be transferred.
