Common use of Trial Run and Final Acceptance Test Clause in Contracts

Trial Run and Final Acceptance Test. 9.5.1 The Trial Run of the Contracted Equipment will be for a period of 90 days starting from the issuance of the certificate of Preliminary Acceptance for the Contracted Equipment. If any Major Communication Failure occurs for reasons attributable to Seller/System Integrator during the Trial Run, the Trial Run shall be suspended and resumed when such Major Communication Failure has been eliminated and the Contracted Equipment repaired by the Seller/System Integrator. If the Major Communication Failure occurs for reasons not attributable to the Seller/System Integrator, the Trial Run shall be suspended and resumed when such Major Communication Failure has been eliminated and the Contracted Equipment repaired by the Seller/System Integrator. The Seller/System Integrator is obligated to provide responsive technical support to the End-user who operates and maintains the Contracted Equipment in accordance with the Operation Manual during the Trial Run period. 9.5.2 Except as otherwise provided in this Service Contract, the Final Acceptance Test on the Contracted Equipment shall be conducted 90 days after issuance of the certificate for Preliminary Acceptance. The Seller/System Integrator shall confirm the testing date with the End-user in writing, and submit a testing scheme and related information in conformity to the final acceptance test procedures and standards described in Appendix 6 of this Service Contract seven (7) days prior to the starting of the Final Acceptance Test.
