Unbundled Packet Switching. SBC-ASI/8-STATE will provide CLEC unbundled packet switching in situations in which SBC-ASI/8-STATE has placed its DSLAM in a remote terminal if all of the following conditions are satisfied: SBC-ASI/8-STATE or its affiliated ILEC has deployed digital loop carrier systems, including but not limited to, integrated digital loop carrier or universal digital loop carrier systems; or has deployed any other system in which fiber optic facilities replace copper facilities in the distribution section (e.g., end office to remote terminal, pedestal or environmentally controlled vault); There are no spare copper loops capable of supporting the xDSL services CLEC seeks to offer; SBC-ASI/8-STATE’s affiliated ILEC has not permitted CLEC to deploy a Digital Subscriber Line Access Multiplexer (“DSLAM”) at the remote terminal, pedestal or environmentally controlled vault or other interconnection point, nor has the requesting carrier obtained a virtual collocation arrangement at these sub-loop interconnection points as defined by 47 CFR §51.319(b); and SBC-ASI/8-STATE has deployed packet switching capability for its own use. SBC-ASI/8-STATE will be relieved of this unbundling obligation if its permits CLEC to collocate CLEC’s DSLAM in SBC-ASI/8-STATE’s remote terminal, on the same terms and conditions as apply to SBC-ASI/8-STATE’s own DSLAM.
