UNFAIR PRACTICES. A. It shall be an unfair practice for the County or its representatives to:
1. Interfere with, restrain, or coerce public employees in the exercise of rights granted in this collective bargaining agreement.
2. Dominate, interfere, or assist in the formulation, existence or administration of any employee organization, or contribute financial support to any organization.
3. Encourage or discourage membership in any employee organization by discrimination in hiring, tenure, training or other terms or conditions of employment.
4. Discharge or discriminate against any employee because he has filed any affidavit, petition, grievance, or complaint or given any information or testimony alleging violations of this Agreement, or because he has formed, joined, or chosen to be represented by any employee organization.
B. It shall be an unfair practice for the Association or its representatives or agents to:
1. Restrain or coerce any employee in the exercise of any rights granted under this Agreement, the County Personnel Rules, State law or any other rules or regulations.
2. Cause or attempt to cause an employee to discriminate against another employee because of the employee's membership or non-membership in any employee organization or attempt to cause the County to violate any rights of the employee.
3. Discriminate against any employee because he has signed or filed an affidavit, petition or complaint or given any information or testimony alleging violations of this Agreement.
C. Notwithstanding the provisions of subsections A and B, the parties' rights of free speech shall not be infringed upon and the expression of any arguments or opinions shall not constitute or be evidence of an unfair practice or of this Agreement provided such expression contains no promise of benefits nor threat of reprisal or force.
UNFAIR PRACTICES. The parties agree that Article 20, Sections 2014 and 2015 of the Ventura County Personnel Rules and Regulations shall be removed from the jurisdiction of the Civil Service Commission Charges of unfair practices shall be submitted to advisory arbitration. The request for advisory arbitration shall be made in accordance with Section 3209. The cost of advisory arbitration shall be divided equally between VEA and the County.
UNFAIR PRACTICES. 2.01 No employee shall be discharged or discriminated against for any lawful union activity or for serving on a Union committee outside of business hours or for reporting to the Union the violation of any provision of this Agreement.
2.02 It shall be the policy of the Company and the Union not to discriminate because of race, gender, creed, colour, age, religion, national origin, ancestry, or sexual orientation.
UNFAIR PRACTICES. 3.1 The Civil Works Merchant specifically agrees, covenants and undertakes that the Civil Works Merchant shall not, either directly or through any agent, employee or person including any affiliates, group companies, corporation, partnership, joint venture, trust, society or other unincorporated body which is, or shall be, wholly or substantially, owned or controlled by the Civil Works Merchant, during the subsistence of the Term:
(i) solicit any of the customers/users or encourage any of the customers/users to make purchases or avail services from its own store/business/outlet/online website or any other online portals other than from the website (▇▇▇.▇▇▇▇▇▇▇▇▇.▇▇▇);
(ii) conduct such acts, activities or deeds that may disrupt or harm the brand loyalty of the customers/users towards the Service Provider;
(iii) provoke and conduct such acts, deeds or activities, that may result in decrease in the customer retention rate of the Service Provider or increase customer/user dejection (including and not limited to negative feedback or low rating) for the Service Provider and it’s aided services;
(iv) directly promote, market or sell any other products or services offered by the Civil Works Merchant to the Customer; and
(v) increase or decrease the Project Value without intimating the Service Provider or remit or receive unauthorized payments to or from the Customer in relation to the Civil Project.
3.2 The Civil Works Merchant shall be responsible to indemnify the Service Provider against all direct, indirect, special damages, losses as maybe incurred by the Service Provider due to the Unfair Practices of the Civil Works Merchant.
UNFAIR PRACTICES. The Company shall cooperate with the Reinsurer in preserving and exercising all legal and contractual rights that may be available to the Company against any person who shall "twist," rewrite, or solicit the lapse or termination of, any of the Coinsured Policies, or who shall otherwise engage in any unfair or deceptive acts or practices in connection with the Coinsured Policies, which acts or practices have caused or may result in deterioration of the block of Policies reinsured by the Reinsurer or in injury to the Reinsurer's commercial interests. The Company shall have the right to approve any action proposed to be taken by, on behalf of, or in the name of, the Company under this Section 5.8, which approval shall not be unreasonably withheld. The Reinsurer shall indemnify, defend and hold the Company harmless from and against any Losses (as defined at Article IX hereof) incurred by the Company as a result of actions taken by or at request of the Reinsurer under this Section 5.8.
UNFAIR PRACTICES. 5.1 The Union, its members or its agents shall not, during their working hours or on Corporation premises, conduct Union activities except as herein provided.
5.2 The Corporation or any of its supervisory employees, shall not, in any way, attempt to persuade any employee to refrain from becoming an officer or representative of the Union, or from exercising his lawful rights as a member of the Union.
UNFAIR PRACTICES. There is no unfair labour practice charge or complaint with respect to employees of Digital or HPB pending before any agency, authority, board or court.
UNFAIR PRACTICES. Coinsurer shall indemnify, defend and hold the Company harmless from and against any Loss incurred by the Company as a result of actions taken by or at request of Coinsurer under this Section.
UNFAIR PRACTICES. At no time will any teacher-itinerant be subjected to attempted or consummated interference, restraint, coercion, or discrimination by the Governing Board or its representatives when engaged in the exercise of those rights guaranteed by the Law and this Agreement.
UNFAIR PRACTICES. Neither Target nor any of its Subsidiaries has engaged in any unfair labour practice and no unfair labour practice complaint, grievance or arbitration proceeding is pending or, to the knowledge of Target, threatened against Target or any of its Subsidiaries.
