Union Delegates Charter. 6.6.1 Essential Energy shall be able to: a) Expect that employees, be they Union Delegates or not, will perform the job in which they are employed. b) Be given reasonable notice by Delegates that they intend to carry out their Union duties. c) Expect that Union Delegate(s) shall not be able to claim or be paid overtime for attendance at Delegates meetings. d) Expect that Union Delegate(s) be reasonably available as required to assist in the facilitation of effective workplace relations practices. 6.6.2 To the extent permitted by the Fair Work Act 2009, Union Delegates at Essential Energy shall be able to: a) Approach, or be approached by a member for the payment of union dues or other payments, or to discuss any matter related to this member’s employment, during working hours. b) After obtaining the permission of the employer, move freely for the purpose of consulting other Delegates during working hours. c) Have access to Union Officials, subject to the Fair Work Act 2009, as required within operational hours and on business premises as required for the purposes of Union business. d) Be able to represent employees or request a Union Official to represent the employee. e) To negotiate with management together with other Union Delegates on behalf of all or part of the members on any matters in accord with union policy affecting the employment of members who work in Essential Energy. f) Call meetings and for members to attend these meetings on the job. Such meetings are to be outside of work time unless prior permission is obtained from management. g) Have protection from victimisation and this right to be expressed in prohibiting the employer from seeking to separate the delegate from the union members who elected them without first consulting the union. h) Have access to a telephone and computer, including email and to have within their work proximity suitable cupboards and furniture to enable them to keep records, union circulars, receipt books etc. so as to efficiently carry out their union responsibilities. i) Attend meetings and training held by the union in which they hold office without loss of any rights or ordinary pay following the approval of Essential Energy. Attendance at these meetings shall not be unreasonably withheld. Union Delegates Charter. 33.1 The Employer and the Employees recognise the right of the Employees to elect a delegate and that the delegate is empowered to promote good workplace relations practices and participate in dispute resolution. 33.2 The Master must be advised of the appointment of delegates or a change of delegates. 33.3 In enhancing the efficiency of delegates, the following principles are agreed: (a) The right to be treated fairly and to perform their role as a Union delegate without any discrimination in their employment; (b) The right to formal recognition by the Employer or their representatives that endorsed Union delegates speak on behalf of the Union members on that particular vessel; Svitzer Australia Onslow Operations Masters Enterprise Agreement 2023 (c) The right to consult with vessel management with reasonable access around the vessel; (d) The right to reasonable paid time off as a ‘Dead Day’, to participate in approved forums with the Employer where staff representation is appropriate such as: (i) Enterprise agreement negotiations; and (ii) Other matters agreed between the Employer and the Union as appropriate. (e) The right of each delegate to relevant portfolio training; (f) The right to reasonable access on the vessel to telephone, email, facsimile, photocopying, internet and other facilities where available for the purpose of carrying out the delegate’s responsibilities and consulting with workplace colleagues and the Union; (g) The right to place Union and other relevant information concerning this Agreement on the vessel’s noticeboard; (h) The right to take reasonable leave without pay to work with the Union at a time agreed with the Employer. Should this leave be granted it shall not break the Employee’s continuity of service; and (i) Nothing in this clause authorises the delegate to prejudice non-Union members in their employment or authorises the Employer to discriminate against non-Union members

  • Union Delegates The Employer recognizes the right of the Union to designate Union Delegates who shall be authorized to take up employee or group grievances through the grievance procedure. A Union Delegate who is a bargaining unit employee and is processing a grievance in accordance with the grievance procedure shall be permitted a reasonable time to assist in the resolution of legitimate employee grievances on the Employer's property without loss of pay. Such time off for processing grievances shall be granted by supervision following a request, but in consideration of any job responsibilities.

  • Union Delegate Where an Employee is elected by Employees of the Employer as a Union Delegate, and the Union notifies the Employer of this election, the Employee will be classified as the higher of CW4, or the Employees usual classification. In addition, a Union Delegate is entitled to an all- purpose hourly allowance for the life of this agreement as per the table at Appendix 2 – Delegate Allowance.

  • Union Delegate Rights 51.1 To the extent that the provisions of clause 36A of the Award may confer a more favourable benefit upon a workplace delegate than the explicit terms of this clause, those provisions will operate as terms of this clause. 51.2 Where an Employee has been elected as a Union Delegate, the Employer will recognise the following rights: (a) the right to be treated fairly and to perform their role without any discrimination in their employment; (b) for the Union Delegate to represent an Employee when requested in relation to a grievance, dispute or a discussion with a member of the Union; (c) the right to place information on a notice board in a prominent location in the workplace except that the material must not breach freedom of association, privacy and other applicable laws; (d) the right to paid time to attend industrial tribunals and/or courts where they have been requested to do so by an Employee (which may include themselves) whom they represent in a particular dispute in their workplace; (e) the right to paid time to assist and represent Employees who have requested them to represent them in respect of a dispute arising in their workplace; (f) the right to represent the interests of members in their workplace to the Union, Employer and industrial tribunals/courts; and (g) the right to paid time to attend Union meetings for the purposes of the Union and Project related matters, typically monthly or as reasonably required. 51.3 Union Delegates will be paid the classification rate applicable to their substantive role taking into consideration their skills and/or tickets. 51.4 The Employer will consult and agree with the Union prior to the Employer making a decision to terminate or transfer a Union Delegate/Employee Representative.The Union Delegate/Employee Representative is entitled to one week’s notice in advance of such termination or transfer. Payment in lieu of notice may be made by agreement.

  • UNION DELEGATE FACILITIES 45.1 The Employer shall provide an agreed facility for the use of the Union Delegate to perform their duties and functions as the on-site representative of the Employees. The provision of the following facilities is to ensure that the Union Delegate is able to effectively perform their functions in a professional and timely manner. The facilities shall include: (a) a telephone (b) an iPad equipped with mobile Internet access (c) a table and chairs (d) a filing cabinet (e) air-conditioning/heating (f) access to stationery and other administrative facilities, including use of facsimile, use of e- mail, (if available on site), following consultation between the Union Delegate and Site Management (g) a private lockable area.

  • Union Delegate/Employee Representative Facilities The Employer shall provide an agreed facility for the use of the Union Delegate/ Employee representative to perform their duties and functions as the on-site representative of the Employees.
