Common use of Union Recognition and Membership Clause in Contracts

Union Recognition and Membership. (i) For the duration of the agreement ▇ ▇ ▇▇▇▇▇▇ recognises the National Union of Workers (NSW Branch) as being the union that shall have exclusive representation of all employees covered by the Agreement. This exclusive representation will extend to all terms and conditions of employment, whether those terms and conditions are subject to this agreement. (ii) It is agreed that all new employees subject to this agreement will be given the opportunity to join the National Union of Workers (NSW Branch) as part of the induction programme. (iii) ▇ ▇ ▇▇▇▇▇▇ undertakes upon written authorisation to deduct union membership dues, as levied by the National Union of Workers (NSW Branch) in accordance with its rules, from the pay of employees, who are members of the National Union of Workers (NSW Branch). The amounts will be deducted weekly and remitted monthly together with all necessary information to enable reconciliation and crediting of subscriptions to members’ accounts. There shall be no requirement to make deductions for direct casual employees with less than two month's service (continuous or otherwise) (iv) The Union shall advise the employer of any change to the amount of membership fees made under its rules, provided that this does not occur more than once in any calendar year. Such advice shall be in the form of a schedule of fees to be deducted specifying either weekly, fortnightly, monthly, or quarterly as the case may be. The Union shall give the employer a minimum of two months' notice of any such change. (v) An employee may at any time revoke in writing an authorization to the employer to make payroll deductions of Union membership fees. (vi) Where an employee who is a member of the Union and who has authorised the employer to make payroll deductions of Union membership fees resigns his or her membership of the Union in accordance with the rules of the Union, the Union shall inform the employee in writing of the need to revoke the authorisation to the employer in order for payroll deductions of union membership fees to cease. (vii) All new employees have access to the EBA and shall be introduced to the site NUW delegate upon being accepted for employment.

(g) An employee may at any time revoke in writing an authorization elected as a union delegate will, upon notification to the employer Strandbags, be recognised as a union delegate. A union delegate is allowed up to make payroll deductions of Union membership fees. (vi) Where an employee who is a member 30 minutes per week during working hours to conduct matters on behalf of the Union and who has authorised the employer to make payroll deductions of Union membership fees resigns his or her membership of the Union in accordance with the rules of the Union, the Union shall inform the employee in writing of the need to revoke the authorisation to the employer in order for payroll deductions of union membership fees to ceaseon industrial matters affecting employees whom they represent. (vii) All new employees have access to the EBA and shall be introduced to the site NUW delegate upon being accepted for employment.

Union Recognition and Membership. (i) For Section 2.1. The County recognizes the duration Union as representing its members in job classification 4203100 Legal Administrative Specialist 1, 4203200 job classification Legal Administrative Specialist II, and job classification 4203300 Legal Administrative Specialist III. Section 2.2. It shall be a condition of the agreement ▇ ▇ ▇▇▇▇▇▇ recognises the National Union of Workers (NSW Branch) as being the union employment that shall have exclusive representation of all regular full time, regular part time, and term-limited temporary employees covered by the Agreement. This exclusive representation will extend to all terms and conditions of employment, whether those terms and conditions are subject to this agreement. (ii) It is agreed that all new employees subject to this agreement will be given the opportunity to join the National Union of Workers (NSW Branch) as part of the induction programme. (iii) ▇ ▇ ▇▇▇▇▇▇ undertakes upon written authorisation to deduct union membership dues, as levied by the National Union of Workers (NSW Branch) in accordance with its rules, from the pay of employees, Agreement who are members of the National Union in good standing on the effective date of Workers this Agreement shall remain members in good standing or pay an agency fee to the Union for their representation to the extent permitted by law. Provided, however, that nothing contained in this section shall require an employee to join the Union whose religious beliefs prohibit the payment of dues or initiation fees to Union organizations, in which case the employee shall pay an amount of money equivalent to regular union dues and initiation fee to a non-religious charitable organization mutually agreed upon by the employee affected and the bargaining representative to which such employee would otherwise pay the dues and initiation fee. The amounts will be deducted weekly employee shall furnish written proof that such payment has been made. If the employee and remitted monthly together with all necessary information the Union cannot agree on the non-religious charity, the Public Employment Relations Commission shall designate the charitable organization. (vi) Where an employee who is a member secretary-treasurer of the Union and who has authorised transmit the employer same to make payroll deductions of Union membership fees resigns his or her membership of the Union in accordance with the rules secretary-treasurer of the Union. The Union will indemnify, defend and hold the County harmless against any claims made and against any suit instituted against the County on account of any check-off of dues for the Union. The Union agrees to refund to the County any amounts paid to it in error on account of the check-off provision upon presentation of proper evidence thereof. Section 2.4. Failure by employees to abide by the above provisions shall constitute cause for discharge of such employees; provided that when an employee fails to fulfill the above obligations the Union shall inform provide the employee in writing and the County with thirty (30) days notification of the need Union’s intent to revoke initiate discharge action and during this period the authorisation employee may make restitution in the amount which is overdue. Section 2.5. The County will require all new employees hired into a position included in the bargaining unit to sign a form (in triplicate) which will inform them of the Union’s exclusive recognition. (One copy of the form will be retained by the County, one by the employee and the original sent to the employer in order for payroll deductions Union.) The County will notify the Union of union membership fees to ceaseany employee leaving the bargaining unit because of termination, layoff, leave of absence or dismissal.
