UNION SECURITY AND CHECKOFF. Section 1. Management will make available to all employees entering the bargaining unit a copy of this agreement calling their attention to the fact that The Grand Rapids Employees Independent Union has been recognized as the exclusive bargaining representative for all employees in the bargaining unit. Section 2. Management will make available to all employees in the bargaining unit, within a reasonable period of time following the execution thereof, a copy of this Agreement. Section 3. The provisions of Article 40, Section 1 and Article 41, Section 1 notwithstanding, in the event that there is a change in existing law that allows an agency shop relationship the Union has the right to reopen this agreement to bargain regarding modifications to the agreement on that topic rather than waiting to the end of the existing contractual period. a. Management agrees that it will not make a series of seasonal hires for the purpose of filling a permanent bargaining unit position provided for in the City Budget or for the purpose of avoiding the filling of a position on a permanent basis which would otherwise result in a position in the bargaining unit. It is expressly understood that nothing contained in this Agreement will limit the right of Management to hire seasonal employees nor limit the right of Management to make seasonal hires to fill positions temporarily open as a result of leave of absence, sick leave, vacation, or similar reasons. Similarly, the City agrees that it will not utilize temporary service contract personnel to avoid filling a permanent bargaining unit position provided for in the City budget or for the purpose of avoiding the creation of a full-time permanent position. However, it is expressly understood that nothing contained herein shall apply to the operations of the Grand Center or existing parking facilities of the City. It is further understood that the above provision shall have no application to situations wherein the City elects to exercise its right to subcontract bargaining unit work as provided in Article 5.
