Common use of Unlawful Use of Service Clause in Contracts

Unlawful Use of Service. Services provided by GTE pursuant to this Agreement shall not be used by GSCOMM or its end users for any purpose in violation of law. GSCOMM, and not GTE, shall be responsible to ensure that GSCOMM and its end users’ use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to GSCOMM or disconnect particular services provided under this Agreement to GSCOMM or, as appropriate, GSCOMM's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to GSCOMM, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of GSCOMM and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

GSCOMMANNOX, and not GTE, shall be responsible to ensure that GSCOMM ANNOX and its end users’ use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to GSCOMM ANNOX or disconnect particular services provided under this Agreement to GSCOMM ANNOX or, as appropriate, GSCOMMANNOX's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. GTE may refuse to furnish service to GSCOMM EZ Talk or disconnect particular services provided under this Agreement to GSCOMM EZ Talk or, as appropriate, GSCOMMEZ Talk's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to GSCOMMEZ Talk, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of GSCOMM EZ Talk and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

GTE may refuse to furnish service to GSCOMM RECONEX or disconnect particular services provided under this Agreement to GSCOMM RECONEX or, as appropriate, GSCOMMRECONEX's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to GSCOMMRECONEX, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of GSCOMM RECONEX and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

GSCOMMLONE STAR, and not GTE, shall be responsible to ensure that GSCOMM LONE STAR and its end users’ use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to GSCOMM LONE STAR or disconnect particular services provided under this Agreement to GSCOMM LONE STAR or, as appropriate, GSCOMMLONE STAR's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to GSCOMMLONE STAR, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of GSCOMM LONE STAR and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

GSCOMMNEW PHONE, and not GTE, shall be responsible to ensure that GSCOMM NEW PHONE and its end users’ users use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to GSCOMM NEW PHONE or disconnect particular services provided under this Agreement to GSCOMM NEW PHONE or, as appropriate, GSCOMMNEW PHONE's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to GSCOMMNEW PHONE, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of GSCOMM NEW PHONE and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.

GSCOMMSuretel, and not GTE, shall be responsible to ensure that GSCOMM Suretel and its end users’ use of services provided hereunder comply at all times with all applicable laws. GTE may refuse to furnish service to GSCOMM Suretel or disconnect particular services provided under this Agreement to GSCOMM Suretel or, as appropriate, GSCOMMSuretel's end user when (i) an order is issued by a court of competent jurisdiction finding that probable cause exists to believe that the use made or to be made of the service is prohibited by law or (ii) GTE is notified in writing by a law enforcement agency acting within its jurisdiction that any facility furnished by GTE is being used or will be used for the purpose of transmitting or receiving gambling information in interstate or foreign commerce in violation of law. Termination of service shall take place after reasonable notice is provided to GSCOMMSuretel, or as ordered by the court. If facilities have been physically disconnected by law enforcement officials at the premises where located, and if there is not presented to GTE the written finding of a court, then upon request of GSCOMM Suretel and agreement to pay restoral of service charges and other applicable service charges, GTE shall promptly restore such service.
