Unsafe Work. a) The Company and the Union agree to cooperate in developing and maintaining a strong sense of safety awareness among employees and supervisors. It is, therefore, recognized that every employee has the right to refuse work if they have reasonable cause to believe that to perform the work would create undue hazard to the health or safety of any person. b) When a worker has refused to perform unsafe work, the employer shall not assign any other employees to use or operate the tool or equipment, work in that place or perform the activity referred to in the work refusal unless; (i) The Supervisor is satisfied on reasonable grounds that the other employee will not be exposed to any undue hazard, (ii) The other worker has been advised of the refusal of the employee concerned and of the reasons for the refusal; and (iii) The other worker has been advised of their right to refuse unsafe work.
