Unsupported Products. If Registered Partner elects not to Resell Services at the time of Product purchase or if Product becomes unsupported due for whatever reason at some point subsequent to initial deployment, Registered Partner shall refer End User information, including but not limited to End User name, address and phone number to Cisco within ninety (90) days of Product becoming unsupported and authorizes Cisco to contact the End User for the express purpose of contracting directly for support services for the unsupported Product identified by Registered Partner.
Unsupported Products. If the Product you have received with this license is or includes (i) Evaluation Products, (ii) Pre-Released Products, or (iii) SDKs (collectively, "Unsupported Products"), then you will pay for repair of damages to, or the list price of, the Unsupported Products, as applicable, due to theft, or loss of or damage to Unsupported Products from the time you receive such Products until Licensor receives the Unsupported Products back upon conclusion of your applicable use. To the extent that any provision in this Section conflicts with any other term in this Agreement, this Section will supersede such other term(s) with respect to the Unsupported Products, but only to the extent necessary to resolve the conflict. Unsupported Products are provided to you "AS-IS" and Licensor disclaims any warranty or liability obligations to you of any kind. Maintenance is not available for the Unsupported Products. Licensor may change, suspend, or discontinue any aspect of the Unsupported Products at any time, including the availability of any Unsupported Product, and impose limits on certain features and services or restrict your access to parts or all of Pre-Released and SDK Products. Licensor's ownership rights and the restrictions in Section 2, apply to Unsupported Products. To the maximum extent permitted by applicable law, you hereby (iv) release Licensor and its subsidiaries, affiliates, officers, agents, licensors, and employees (collectively, "Indemnitees") from liability for Claims, and waive all Claims against Indemnitees, arising from or in any way related to your use of the Unsupported Products; and (v) agree to hold harmless, indemnify and defend Indemnitees from and against any and all Claims arising from or related to your use of the Unsupported Products.

To the extent that any provision in this section is in conflict with any other term or condition in this Agreement, this section shall supersede such other term(s) and condition(s) with respect to the Unsupported Products, but only to the extent necessary to resolve the conflict. You acknowledge that the Unsupported Products may contain bugs, errors and other problems that could cause system or other failures and data loss. Consequently, Unsupported Products are provided to you "AS-IS" and Zyrion disclaims any warranty or liability obligations to you of any kind. Zyrion support service offerings are not available for the Unsupported Products. WHERE LEGAL LIABILITY CANNOT BE EXCLUDED, BUT MAY BE LIMITED, ZYRION’S LIABILITY AND THAT OF ITS SUPPLIERS AND AUTHORIZED PARTNERS SHALL BE LIMITED TO THE AMOUNT PAID OR PAYABLE BY YOU TO ZYRION FOR THE PRODUCTS LICENSED HEREUNDER FROM WHICH SUCH LOSS OR DAMAGE DIRECTLY AROSE. Unsupported Products. If Reseller elects not to Resell Services at the time of purchase by an End User of any Arqit Product, Reseller shall promptly notify Arqit and hereby authorises Arqit to contact the End User for the express purpose of contracting directly for support services for any unsupported Arqit Product identified by Reseller.

  • Licensed Products Lessee will obtain no title to Licensed Products which will at all times remain the property of the owner of the Licensed Products. A license from the owner may be required and it is Lessee's responsibility to obtain any required license before the use of the Licensed Products. Lessee agrees to treat the Licensed Products as confidential information of the owner, to observe all copyright restrictions, and not to reproduce or sell the Licensed Products.

  • Products Products available under this Contract are limited to Software, including Software as a Service, products and related products as specified in Appendix C, Pricing Index. Vendor may incorporate changes to their product offering; however, any changes must be within the scope of products awarded based on the posting described in Section 1.B above. Vendor may not add a manufacturer’s product line which was not included in the Vendor’s response to the solicitation described in Section 1.B above.
