Upon Substantial Completion of the Work Sample Clauses

Upon Substantial Completion of the Work or designated portion thereof and upon application by the Contractor and certification by the Architect, the Owner shall make payment, reflecting adjustment in retainage, if any, for such Work or portion thereof as provided in the Contract Documents.
Upon Substantial Completion of the Work. Owner shall release to Design-Builder all retained amounts relating, as applicable, to the entire Work, less an amount equal to the reasonable cost to complete all remaining or incomplete items of Work as noted in the Certificate of Substantial Completion.
Upon Substantial Completion of the Work. Owner shall pay Construction Manager a sum sufficient to increase the total payments to the Construction Manager to one hundred percent (100%) of the Cost of Work completed, not to exceed the Cost of the Work portion of the Guaranteed Maximum Price, less retainages as the Architect and Owner shall in good faith determine for all incomplete work and unsettled claims and less the retainage Owner is authorized to withhold from Construction Manager’s Fee under Section 7.1.7 above. Notwithstanding other provision of the Contract, the Owner may withhold funds due the Construction Manager sufficient to satisfy claims filed by laborers or materialmen, as authorized by applicable Property Code. In addition thereto, the Owner may withhold funds to the extent Owner is otherwise entitled to withhold from payment to Construction Manager in accordance with the Contract Documents and Applicable Law.

The Participating County agrees to complete the Project in accordance with this Agreement and consistent with the scope, cost and schedule established by the Board and attached hereto in Exhibit A, as such scope, cost and schedule may be modified with the approval of Finance and the recognition of the Board.
