Use by Other Governmental Entities. In the event that HCDE/CP allows other governmental entities to “piggyback” onto any existing contract between HCDE and Vendor entered into pursuant to this procurement solicitation, Vendor agrees and understands that such other governmental entities may include “school food authorities,” as that term is used in SP 35-2012. Should the “piggybacking” result in a material change to the Agreement for purposes of USDA/TDA purchases, HCDE/CP will proceed under the foregoing section entitled “Material Changes.”
Use by Other Governmental Entities. This Agreement may be used by other Governmental Entities, including but not limited to other state governments and political subdivisions thereof. See the definition of Purchasing Entity below.
Use by Other Governmental Entities. This Agreement may be extended for use by other municipalities, government agencies and governing bodies, including the Arizona Board of Regents and political subdivisions of the State. Any usage by other entities must be in compliance with applicable laws, ordinances, charters, and rules and regulations of the respective entity and must be approved by the City and Contractor.
Use by Other Governmental Entities. Nevada Revised Statutes 332.195 states that local governments and the State of Nevada may use the contracts of other local governments within Nevada, if approved by Provider. The local government that originally awarded the contract is not liable for the obligations of the local government which uses the contract. 11. AUDITS The performance of Contract by Provider is subject to review by Owner to insure Contract compliance. Provider agrees to provide Owner any and all information requested that relates to the performance of Contract. All requests for information will be in writing to Provider. Time is of the essence during the audit process. Failure to provide the information requested within the timeline provided in the written information request may be considered a material breach of contract and be cause for suspension or termination of Contract.
