2. S151 Officer should be satisfied that the developer is a viable company that has secured enough funding for the project; there is a need for Members to know the source of the funds; This matter is primarily addressed in the response to question 1. However, in addition as part of the final confirmation of the above conditions the council’s Section 151 officer will also be undertaking contemporary assessments of the developer’s cash flow and accounts, together with those of the proposed financiers.
3. Freehold is being proposed to change hands between TDC and the Developer at the payment of the overage. What leverage does TDC have to ensure project completion after surrender of free-hold; This was covered in the Annex to the report to Cabinet on 26th July under a number of provisions set out below. The primary thrust of these provisions being to provide a range of different areas of leverage to try and ensure the completion of the development.
