DATA AVAILABLE. The Owner will make available data related to various County activities. This Agreement specifically excludes providing information which is established as sensitive, reserved, or otherwise restricted by any currently valid law or statute at any level of government. The data available for access is listed in “SECTION VI. ELECTRONIC ACCESS APPLICATION SYSTEMS”, which may be amended from time to time through the addition or deletion of application systems.
DATA AVAILABLE. The Server Site shall allow the Connected Site to maintain separate records and data specific to each party’s ▇▇▇▇▇▇▇▇ Flex System. Because data for each party is stored on the same server, each party will have access to computer programs and stored data within the ▇▇▇▇▇▇▇▇ System. Access to the Connected Site’s data will be established and directed by the Server Site and in cooperation with the Connected Site’s participation and approval. Data entered into the system by any party becomes a part of the server database and will be subject to maintenance or archival procedures as determined by the Server Site. Access to the servers at the Server Site shall be limited only to the retrieval, modification, and use of information contained in the ▇▇▇▇▇▇▇▇ System. Data Entry should be at a high level of priority for each agency, it must be understood that all data entry must be completed with accuracy and consistency. All entries must be validated. Extent of all use and access shall conform to the regulations set forth in applicable federal, state, and local law to include Criminal Justice Information System (CJIS) Policy. Either party will sell, give, loan, lease or otherwise transfer title, possession, or allow access or use of any of the data or screens by any person, firm, corporation, or association without prior written approval of the other parties. Either party may deny any of the aforementioned acts to be undertaken by the other parties. Dissemination of data or information is the responsibility of the agency recording the data or information in accordance with this Agreement and the Texas Public Information Act, if applicable. All requests for information made pursuant to the Public Information Act shall be forwarded to both parties for further review. Other entities will not disclose data except through specific contracts and agreements with application and data owners.

DATA AVAILABLE. (a) Owner shall, without charge, furnish to or make available for examination or use by Company as it may request, any data which Owner has available, including as examples only and not as a limitation: (i) Copies of reports, surveys, records, and other pertinent documents. (ii) Copies of previously prepared reports, job specifications, surveys, records, ordinances, codes, regulations, other documents, and information related to the services specified by this Contract. (b) Owner shall assist Company in obtaining data on documents from public officers or agencies, and from private citizens and business firms, whenever such material is necessary for the completion of the services specified by this Contract. (c) Company will not be responsible for accuracy of information or data supplied by Owner or other sources to the extent such information or data would be relied upon by a reasonably prudent Company. (d) The Company shall return any original data provided by the Owner.

  • Information Available So long as the Registration Statement is effective covering the resale of Shares owned by the Investor, the Company will furnish to the Investor: (a) as soon as practicable after it is available, one copy of (i) its Annual Report to Stockholders (which Annual Report shall contain financial statements audited in accordance with generally accepted accounting principles by a national firm of certified public accountants) and (ii) if not included in substance in the Annual Report to Stockholders, its Annual Report on Form 10-K (the foregoing, in each case, excluding exhibits); (b) upon the reasonable request of the Investor, all exhibits excluded by the parenthetical to subparagraph (a)(ii) of this Section 7.5 as filed with the SEC and all other information that is made available to shareholders; and (c) upon the reasonable request of the Investor, an adequate number of copies of the Prospectuses to supply to any other party requiring such Prospectuses; and the Company, upon the reasonable request of the Investor, will meet with the Investor or a representative thereof at the Company's headquarters to discuss all information relevant for disclosure in the Registration Statement covering the Shares and will otherwise cooperate with any Investor conducting an investigation for the purpose of reducing or eliminating such Investor's exposure to liability under the Securities Act, including the reasonable production of information at the Company's headquarters; provided, that the Company shall not be required to disclose any confidential information to or meet at its headquarters with any Investor until and unless the Investor shall have entered into a confidentiality agreement in form and substance reasonably satisfactory to the Company with the Company with respect thereto.

  • Currently Available Existing as part of CenturyLink’s network at the time of a requested order or service. Currently Available does not include any service, Network Element, facility, feature, function or capability that CenturyLink either does not provide to itself or to its own End Users, does not have the capability to provide, or is not required to provide on a resold or unbundled basis under Applicable Law.

  • System Availability Although we will try to provide continuous access to the Service, we cannot and do not guarantee that the Service will be available 100% of the time and will not be liable in the event Service is unavailable. Actual service or network performance is dependent on a variety of factors outside of our control. If you notify us within twenty-four (24) hours and we confirm an outage consisting of a period of two (2) hours in any calendar month, and not due to any service, act, or omission of you, a third party, your applications, equipment or facilities, or reasons outside of our control, you shall be eligible for a service credit. A service credit shall be computed as a pro-rated charge for one day of the regular monthly fees for the Service in the next monthly statement. Intermittent service outages for periods of less than two (2) hours are not considered service outages. Outages caused by routine scheduled maintenance are also not considered an outage. You shall receive advance notice no less than forty-eight (48) hours in advance of our scheduled maintenance. Scheduled maintenance will be performed between 12:00 a.m. and 6:00 a.m. CST.

  • Product Availability Under no circumstances shall Company be responsible to Representative or anyone else for its failure to fill accepted orders, or for its delay in filling accepted orders, when such failure or delay is due to strike, accident, labor trouble, acts of nature, freight embargo, war, civil disturbance, vendor problems or any cause beyond Company's reasonable control.

  • DNS name server availability Refers to the ability of a public-­‐DNS registered “IP address” of a particular name server listed as authoritative for a domain name, to answer DNS queries from an Internet user. All the public DNS-­‐registered “IP address” of all name servers of the domain name being monitored shall be tested individually. If 51% or more of the DNS testing probes get undefined/unanswered results from “DNS tests” to a name server “IP address” during a given time, the name server “IP address” will be considered unavailable.
