Common use of Use of De-identified Data Clause in Contracts

Use of De-identified Data. Contractor may use De-identified Data for purposes of research, the improvement of Contractor’s products and services, and/or the development of new products and services. In no event shall Contractor or Subcontractors re-identify or attempt to re-identify any De-identified Data or use De-identified Data in combination with other data elements or De-identified Data in the possession of a third-party affiliate, thereby posing risks of re-identification.

Use of De-identified Data. Contractor may use De-identified Data for purposes of research, the improvement of Contractor’s products and services, and/or the development of new products and services. In no event shall Contractor or Subcontractors re-identify or attempt to re-re- identify any De-identified Data or use De-identified Data in combination with other data elements or De-identified Data in the possession of a third-party affiliate, thereby posing risks of re-re- identification.

Performance and Usage Data may also be used and shared with third party web analytical tools for tracking analytical information and for educational research purposes. In no event shall Contractor or Subcontractors re-identify or attempt to re-identify any De-identified Data or use De-De- identified Data in combination with other data elements elements. Contractor shall prohibit its Subcontractors from re-identifying or attempting to re-identify De-identified Data in the possession of a third-party affiliate, thereby posing risks of re-identificationData.

However, Contractor may only use De-identified Data for purposes of research with the prior written approval of the District’s Research Review Board. In no event shall Contractor or Subcontractors re-identify or attempt to re-identify any De-identified Data or Data. Contractor shall not use De-identified Data in combination with other data elements or De-identified Data in the possession of a third-party affiliate, thereby posing risks of Subcontractor so as to allow for re-identification.
