Use of De-identified Data. Business Associate may de-identify PHI and utilize ▇▇-▇▇▇▇- tified PHI for purposes other than research, provided that Business Associate (i) ▇▇-▇▇▇▇- tifies the PHI pursuant to the HIPAA requirements set out in 45 C.F.R. § 164.514(b) and (ii) provides Covered Entity with appropriate documentation if required by 45 C.F.R. § 164.514(b)(1)(ii). De-identified information does not constitute PHI and, with the ex- ception of paragraph 1.2(f) below, is not subject to the terms of this Agreement.
