Use of Involuntary Referrals Sample Clauses

The 'Use of Involuntary Referrals' clause defines the circumstances under which a party may refer an individual to a service or program without their explicit consent. Typically, this clause outlines the criteria for such referrals, such as safety concerns, legal requirements, or the individual's inability to make informed decisions. By establishing clear guidelines for involuntary referrals, the clause ensures that such actions are taken only when necessary and justified, thereby balancing individual rights with the need to protect welfare and comply with legal or ethical obligations.

Use of Involuntary Referrals. 1. Any involuntary EAP referrals are for the purpose of determining whether an individual has a problem that is having a negative effect on behavior or performance on the job and whether this problem can be corrected through counseling or more formal health intervention. 2. Involuntary referrals to the EAP are not to be retaliatory in nature or used as punishment. It is extremely important that supervisors are trained in the proper use of the disciplinary and fit for duty referrals so that abuse of these types of referrals does not occur. 3. Involuntary referrals are not to be based on rumors, third-party reports, or behavior that occurs away from the job site. 4. There must be clear documentation of unacceptable behavior or declining job performance that leads to an involuntary referral to the EAP. 5. Supervisors are not to attempt to diagnose or make treatment recommendations if they believe an employee is having a mental health or substance abuse problem. 6. A conference must occur between the employee and supervisor prior to any requirement for an involuntary EAP intervention. The MBU has the right to have a representative present for an involuntary EAP referral conference. The supervisor will inform the MBU of the right to have such representation present. 7. At the initial conference, the supervisor will inform the employee of the behavior(s) observed and the intent to mandate EAP intervention. The supervisor will provide written documentation of the observed behavior(s) prompting the referral. Such documentation shall not be based solely on the testimony of one (1) individual. 8. Supervisors and union representatives will be trained prior to involuntary referrals being made. Training will emphasize privacy and confidentiality as features of the EAP. The district is responsible for providing annual training in this regard.
