USE OF PHYSICAL FORCE. 1. An employee may use reasonable and appropriate physical force upon a minor when and to the extent it is necessary and appropriate to maintain discipline or promote the welfare of the minor.
2. An employee shall make every attempt to report as soon as possible, but no later than the following morning, to his/her building administrator or central office administrator.
3. As determined by the Superintendent, the District may reimburse an employee for the cost in excess of insurance benefits received for medical, surgical, or hospital services incurred as a direct result of injury sustained in the course of his/her employment, but may not reimburse for consequential damages or for aggravation of pre-existing conditions and shall not exceed the amount of his/her current salary.
4. As determined by the Superintendent, the District may provide legal counsel of its selection to an employee in actions arising out of disciplinary action involving a pupil of the District while in the proper discharge of duties within the scope of his/her employment.
USE OF PHYSICAL FORCE. In the event of an incident involving physical force, by or against a teacher, the teacher shall:
1. Give timely written notice of the incident to the Building Principal with a copy to the Superintendent.
2. Be advised by the District of legal responsibilities and protections offered by the District.
3. Be advised by the District of administrative investigations or hearings concerning the incident.

Within 18 months of the effective date, and annually thereafter, all security staff will receive training on the updated Use of Physical Force policy, including training in conflict resolution, management of assaultive behavior, and approved uses of force that minimize the risk of injury to youth and staff. All training shall include each staff member’s demonstration of the approved techniques and require that staff meet the minimum standards for competency established by the method.

The Revised School Code provides that a teacher may use reasonable physical force upon a student as may be necessary to (a) restrain or remove a pupil whose behavior is interfering with the orderly exercise and performance of school district functions within a school or at a school-related activity, if that pupil has refused to comply with a request to refrain from further disruptive acts; (b) for self-defense or the defense of another;

USE OF PHYSICAL FORCE. SPD Rules and Regulations governing the use of force, specifically, Vol. 1, Art. 4, Sections 2-6, is hereby incorporated by reference into this MOU and should any of the SPD Rules and Regulations change on the use of force during the term of this MOU, such changes are incorporated by reference without requiring the parties to modify or amend this MOU.
