Use of Settlement Payments. 1. The Special Master shall allocate and transfer funds from the Zydus Settlement Trust as follows: 85% of such funds (the “Total Remediation Amount”) shall be paid to ▇▇▇▇ XVIII for distribution to Participating Tribes to use for Opioid Remediation in accordance with the ▇▇▇▇ XVIII Trust Agreement and the ▇▇▇▇ XVIII TDP; and 15% of such funds shall be set aside by the Special Master for the Attorney Fee Fund, including the portion to be withheld pursuant to Section III.A.4. 2. The TAFT XVIII Directors shall set aside and hold back the funds allocable to each of the following Tribes proportionate to the Tribe’s Tribal Allocation Distribution Percentage: a. A Non-Litigating Tribe that has not become a Participating Tribe at the time of such distribution, and the provisions of Section IV.E.1 shall apply with respect to such Non-Litigating Tribe. b. A Litigating Tribe that has not become a Participating Tribe at the time of such distribution, and the provisions of Section IV.E.2 shall apply with respect to such Litigating Tribe. 3. The Special Master shall deduct the costs and expenses incurred in the administration of the Zydus Settlement Trust out of the interest accrued on the Zydus Settlement Trust, and thereafter from the principal of the Zydus Settlement Trust. 4. In no event may less than 85% of Zydus’s payments to the Zydus Settlement Trust be spent on Opioid Remediation. The Parties acknowledge and agree that the payments disbursed to the Tribes from ▇▇▇▇ XVIII in accordance with this Section IV and Schedules B and D of the ▇▇▇▇ XVIII TDP are exclusively for Opioid Remediation.

The Special Master shall allocate and transfer funds from the Zydus Allergan Settlement Trust within 21 days after receiving each of the annual payments of funds, as follows: 85% of such funds (the “Total Remediation Amount”) shall be paid to ▇▇▇▇ XVIII VII for distribution to Participating Tribes to use for Opioid Remediation in accordance with the ▇▇▇▇ XVIII VII Trust Agreement and the ▇▇▇▇ XVIII VII TDP; and 15% of such funds shall be set aside by the Special Master for the Attorney Fee Fund, including the portion to be withheld pursuant Fund subject to Section III.A.4VII to pay attorneys’ fees and litigation costs. 2. The TAFT XVIII ▇▇▇▇ VII Directors shall set aside and hold back the funds allocable to each of the following Tribes proportionate to the Tribe’s Tribal Allocation Distribution Percentage: a. A Non-Litigating Tribe that has not become a Participating Tribe at the time of such distribution, and the provisions of Section IV.E.1 VI shall apply with respect to such Non-Litigating Tribe. b. A Litigating Tribe that has not become a Participating Tribe at the time of such distribution, and the provisions of Section IV.E.2 VI shall apply with respect to such Litigating Tribe. 3. The Special Master shall deduct the costs and expenses incurred in the administration of the Zydus Allergan Settlement Trust out of the interest accrued on the Zydus Settlement Trust, Trust and thereafter from the principal of the Zydus Settlement Trust. 4. In no event may less than 85% of ZydusAllergan’s payments Compensatory Restitution Payments to the Zydus Allergan Settlement Trust be spent on Opioid Remediation. The Parties acknowledge and agree that the payments disbursed to the Tribes from ▇▇▇▇ XVIII VII in accordance with this Section IV V and Schedules B and D of the ▇▇▇▇ XVIII VII TDP are exclusively for Opioid Remediation.

The Parties acknowledge and agree that the payments disbursed to the Tribes from ▇▇▇▇ XVIII XV in accordance with this Section IV and Schedules B and D of the ▇▇▇▇ XVIII XV TDP are exclusively for Opioid Remediation.

Pursuant to those schedules, 85% of such funds (the “Total Remediation Amount”) shall be paid to ▇▇▇▇ XVIII IX for distribution to Participating Tribes to use for Opioid Remediation in accordance with the ▇▇▇▇ XVIII IX Trust Agreement and the ▇▇▇▇ XVIII IX TDP; and 15% of such funds shall be set aside by the Special Master for the Attorney Fee Fund, including the portion to be withheld pursuant to Section III.A.4III.A.3. 2. The TAFT XVIII ▇▇▇▇ IX Directors shall set aside and hold back the funds allocable to each of the following Tribes proportionate to the Tribe’s Tribal Allocation Distribution Percentage: a. A Non-Litigating Tribe that has not become a Participating Tribe at the time of such distribution, and the provisions of Section IV.E.1 shall apply with respect to such Non-Litigating Tribe. b. A Litigating Tribe that has not become a Participating Tribe at the time of such distribution, and the provisions of Section IV.E.2 shall apply with respect to such Litigating Tribe. 3. In no event may less than 85% of ZydusWalgreens’s payments to the Zydus Walgreens Settlement Trust be spent on Opioid Remediation. The Parties acknowledge and agree that the payments disbursed to the Tribes from ▇▇▇▇ XVIII IX in accordance with this Section IV and Schedules B and D of the ▇▇▇▇ XVIII IX TDP are exclusively for Opioid Remediation.

The Parties acknowledge and agree that the payments disbursed to the Tribes from ▇▇▇▇ XVIII XIII in accordance with this Section IV and Schedules B and D of the ▇▇▇▇ XVIII XIII TDP are exclusively for Opioid Remediation.
