For example, if you have £150 left within your credit limit and we give a hotel authorisation for a payment of £100, we cannot allow more than £50 to be spent on the account unless the hotel cancels the authorisation; (d) during the validity period embossed on the card; and (e) by the cardholder solely as your agent. 4.3 The card remains our property and you must return any cards promptly if we ask you to. 4.4 You, and any cardholder, may use the account for the following types of transaction: (a) To make a purchase. (b) To get cash or make a cash-related payment (such as buying traveller’s cheques or foreign currency, placing a bet (or making other gambling payments), or buying money orders). 4.5 You are responsible for each cardholder’s use of the account, including use that makes you break this agreement. We’ll cancel the card when you tell us to, but you should also take reasonable steps to recover and destroy the card. If we refuse to execute a transaction, you can check the hotel cancels Account to ensure there was enough Available Balance to cover the authorisation;transaction, or can ask us why we have not executed a transaction by contacting Customer Services. Unless the law prevents us, we will explain why and we will also tell you what you can do to correct any errors in the transaction.
(d) during 5.3 Your Card is a prepaid card, which means that the validity period embossed on the card; and
(e) Available Balance will be reduced by the cardholder solely as full amount of each transaction and authorisation, plus any applicable taxes and charges, including additional ATM charges if any. You must not use your agentCard if the Full Deductible Amount exceeds the Available Balance. If, for any reason, a transaction is processed for an amount greater than the Available Balance on your Card, you must repay us the amount by which the Full Deductible Amount exceeds your Available Balance immediately after receiving an invoice from us. Should you not repay this amount immediately after receiving an invoice from us we reserve the right to take all steps necessary, including legal action, to recover any monies outstanding.
4.3 5.4 Due to security safeguards, Merchants that accept your Card are required to seek authorisation from us for all of the transactions that you make. There are some circumstances where Merchants may require you to have an Available Balance greater than the value of the transaction you wish to make. You will only be charged for the actual and final value of the transaction you make. Merchants request this as they may need to access more funds than you initially planned to spend. For example:
5.4.1 hotels, rental cars, and restaurants - as Merchants may not be able to accurately predict how much your final bill will be, they may request an authorisation for funds greater than your Available Balance. This is called pre-authorisation.
5.4.2 internet Merchants – certain internet Merchant sites will, on registration or at checkout stage, send a request for payment authorisation to verify if funds are available. This will temporarily impact your Available Balance. Also please bear in mind that many sites will not deduct payment until goods are dispatched so please be aware of this when checking your Available Balance to make sure you always have sufficient funds available to cover your purchases.
5.5 Your Card cannot be used in situations where it is not possible to obtain online authorisation that you have sufficient balance for the transaction. For example: transactions on trains, ships, and some inflight purchases.
5.6 Your Card cannot be used at self service petrol pumps. You can use your Card to pay by taking it to the cashier.
5.7 Your Card should not be used as a form of identification.
5.8 Your Card may not be used for any illegal purpose or in any manner prohibited by law.
5.9 The card remains our property and you must return Available Balance on your Account will not earn any cards promptly if we interest.
5.10 We may ask you toto surrender the Card at anytime for a valid reason in accordance with the provisions in paragraph 17 of this Agreement. If we do so, we will give you back your Available Balance in accordance with paragraph 9 of this Agreement.

The funds subject to the hold will not be available to you for any loss incurred by us arising from other purpose until the use of merchant sends the cardBank the final transaction amount, although the hold will not affect your day trade buying power. Each time you use your Card, you authorize us to reduce the value available on your Card by the amount of the transaction and any applicable fees. Using Your Card. 4.1 a) You may use your Card worldwide at any Merchant that displays the Visa acceptance mark, excluding limited acceptance Merchants in EU/EEA that do not accept prepaid products. h) You acknowledge that balances and Available Funds shown in your Online Portal are only approximate real time balances rather than the settled balances in the Account. We will also deduct any applicable fees as soon as they become payable by you (see the Fees and Limits Section 13).
i) You will receive either an SMS message or an email each month advising that your statement of account is available in your online portal.
j) We may at any time suspend or restrict your Card Tariff for the following reasons:
i. if we are concerned about the security of the Account, Online Portal or your Card; and
ii. if we reasonably suspect the Account, Online Portal or your Card is being used in an unauthorised, fraudulent or grossly negligent manner; If we do so then we will notify you as soon as reasonably practical by means of a phone call, unless we cannot for security reasons or prohibited from doing so by law.
k) If we take any of the steps referred to in Section 4(j), we may ask you to stop using your Card and either return it to us or destroy it. If after further investigations we have a reasonable belief that the circumstances leading to the suspension or restriction of your Card no longer apply, we will remove the restrictions and/or issue you with a replacement Card as appropriate.
l) You can ask us check your Available Balance by logging in to your Online Portal, or by contacting Customer Services.
m) In some circumstances Merchants may require verification that your Available Funds will cover the Transaction amount and initiate a hold on your Available Funds for detailsthat amount. Examples include rental cars. In the event a Merchant places pre- authorisation on the Account, you will not have access to these funds until the Transaction is complete or released by the Merchant which may take up to 30 days.
n) If you use your Card at a fuelling station, subject to Merchant acceptance, your Card may need to be pre-authorised for a pre-determined amount in the relevant currency. If you do not use the whole pre-authorisation or do not have Available Funds to obtain a pre-authorisation, it is possible that the pre-authorised amount will be held for up to 30 days before becoming available to you again.

14.2 Subject to these Terms and Conditions and to the cardfacilities enabling Finance Now to provide you with cash withdrawals being established, you may use your Card to withdraw cash from ATMs.
14.3 Different EFTPOS Terminals and ATMs have different maximum and minimum transaction limits. We may also set maximum and minimum transaction and daily limits for cash withdrawals and EFTPOS transactions. We will advise you of any maximum or minimum limits set by us.
14.4 We may decline any transaction using your Card which would cause your Finance Now Card Facility to exceed your Credit Limit.
14.5 Where you are, or have been, in arrears in repayment of any amount due under your Finance Now Card Facility for 10 days or more, we may decline any transaction using your Card until you cease to be in arrears and we have expressly approved further transactions.
14.6 Unless fraud or gross negligence occurs, you agree that an amount shown on an EFTPOS Receipt or ATM Receipt is conclusive evidence of the price of the goods or services, or the amount of your cash withdrawal, as the case may be, and is the amount of the advance made by us under your Finance Now Card Facility and debited to your Account (plus any commissions or fees negotiated between us and the merchant or financial institution that may be applicable).
14.7 We are not responsible for any decision by any merchant not to accept your Card or any decision by any merchant to refuse to supply you with goods or services using your Card or to impose limits or conditions on the use of your Card. You must pay us all amounts debited whether or not resolve any disputes in this regard directly with the cardholder signs a sales or cash advance vouchermerchant.
4.8 14.8 We convert into sterling are not responsible for (including as to the amount of ongoing provision of), and give no warranty for, any card transaction in goods or services which you obtain from a currency other than sterling merchant using a reference rate set your Card, except as required by VISA which is available on their websitelaw. You must resolve any complaints directly with the merchant.
4.9 14.9 Any refund to you by a merchant is a matter of agreement between you and the merchant only. We can are not responsible for providing any refund except as required by law.
14.10 We are not responsible, and give no warranty, for any loss whether direct or indirect which you incur through using your Card in an EFTPOS Terminal or an ATM. In addition to these Terms and Conditions, the use of your Card in any EFTPOS Terminal or ATM is subject to the conditions imposed from time to time by merchants and, in the case of an ATM, the relevant financial institution responsible for that ATM. Access to any EFTPOS Terminal or ATM is at the relevant merchant’s and/or the financial institution’s sole discretion. They may make a charge for converting such access, which you authorise us to debit to your Account at our discretion.
14.11 We will send you statements in relation to your Finance Now Card Facility in accordance with the amount of a card transaction into sterling. This is continuing disclosure obligations set out in the Charge Card Tariff Disclosure Statement. These will be available online, or will be sent to you via email or to your last known address, unless there have been no transactions during the statement period and the total Closing Balance is nil or you have breached these Terms and Conditions and we have commenced enforcement proceedings. Your statement will show all amounts debited and credited to your Account during the statement period.
14.12 If you believe an EFTPOS Receipt, ATM Receipt or continuing disclosure statement is incorrect in any respect you must notify us immediately by calling our Customer Services Centre on 0800 FNL CARD (0800 365 2273). We will provide you with a transaction dispute form to complete, or you can ask us for detailssubmit the details of a disputed transaction on our website.
14.13 EFTPOS and ATM transactions will be debited to your Account on the day the transaction is made, or as soon as possible thereafter, subject to our right to vary the date of debiting due to circumstances beyond our control. When you use your Card in an EFTPOS Terminal or ATM, the transaction will be processed as soon as we receive notification of the electronic funds device you used.

Using Your Card. 4.1 We 4.1. Your Card can issue be used at any Merchant that displays the Visa Mark, excluding limited acceptance Merchants in EU/EEA that do not accept prepaid cards (fees apply, see clause 13).
4.2. You can use your Card to make purchases in-store, via the internet or over the phone. The Card cannot be used to obtain cash back from Merchants, foreign currency, travellers’ cheques, to settle outstanding balances on credit cards, bank overdrafts or credit agreements, to pay for recurring Transactions or for gambling and betting Transactions.
4.3. When your Card is used to make a card and PIN for use by any individual nominated Transaction with a Merchant we will regard it as authorised by you as a cardholder when you enter your PIN or other security code, or in the case of Contactless purchase Transactions, when your Card is tapped at the point of sale terminal in the Merchant’s store. If the Merchant does not accept chip and PIN, or Contactless authorisations, the Merchant may allow you to authorise the Transaction by signature of the card accountreceipt. On authorisation of the Transaction we will receive notification to proceed with it and we will not be able to stop it. You will be responsible for all Transactions that you and the additional Cardholders authorise, regardless of the manner of such authorisation. We may refuse to execute a Transaction if the Transaction is unlawful or fraudulent and/or you do not have sufficient Available Balance. If we refuse to execute a Transaction, you can check the Account to ensure there was enough Available Balance to cover the Transaction, or can ask us why we have not executed a Transaction by contacting Customer Services. Unless the law prevents us, we will explain why and we will also tell you what you can do to correct any errors in the Transaction. You will be responsible for all Transactions where you or any additional Cardholders authorise such Transaction, regardless of the manner of such authorisation.
4.2 The card must 4.4. Your Card is a prepaid Card, which means that the Available Balance will be signed reduced by the cardholder immediately full amount of each Transaction and authorisation, plus any taxes and charges that are applicable.
4.5. You must not use your Card if the Full Deductible Amount exceeds the Available Balance. If, for any reason, a Transaction is processed for an amount greater than the Available Balance on receipt and can your Card, Utility Warehouse will attempt to collect a sufficient amount to bring your balance back up to £0, from your next monthly bill, unless prohibited by law. Should you not repay this amount within 14 days of receiving the invoice, Utility Warehouse reserve the right to take all steps necessary, including legal action, to recover any monies outstanding.
4.6. Due to security safeguards, Merchants that accept your Card are required to seek authorisation from us for all Transactions you make. There are some circumstances where Merchants may require you to have an Available Balance greater than the value of the Transaction you wish to make. You will only be usedcharged for the actual and final value of the Transaction you make. Merchants request this as they may need to access more funds than you initially planned to spend. For example:
(a) by 4.6.1. Hotels, rental cars, and restaurants – as Merchants may not be able to accurately predict how much your final bill will be, they may request an authorisation of funds greater than your Available Balance.
4.6.2. Internet Merchants - certain internet Merchant sites will, on registration or at checkout stage, send a request for payment authorisation to verify if funds are available; this will temporarily impact your Available Balance. Also please bear in mind that cardholder;
(b) subject to the terms many sites will not deduct payment until goods are dispatched so please be aware of this agreement when checking your balance and ensure that you always have sufficient funds to cover your purchases.
4.6.3. Your Card cannot be used in situations where it is not possible to obtain online authorisation that you have sufficient balance for any illegal purpose;
(c) within the credit limit (any excess over the credit limit will be immediately repayable to us). When working out whether a transaction you want to make is within your credit limit, we take account of transactions we have already authorised but have not yet charged to the accountTransaction. For example, Transactions on trains, ships, in flight purchases and remote terminals designed for rapid low value Transactions (e.g. motorway tolls).
4.7. If a Merchant agrees to give you a refund for a purchase made using your Card, we will transfer the refund into your Account when we receive details of it from the Merchant.
4.8. Your Card should not be used as a form of identification. We will decline any authorisation requests from Merchants using your Card for identification purposes.
4.9. You may use your Card to obtain cash worldwide from any machine that displays the Visa mark. There is a daily cash withdrawal limit of £250 (or equivalent in a foreign currency) per Account however the cash machine provider may have a reduced limit and may charge additional fees. Transaction fees apply (see clause 13). Until we have verified your identity in accordance with applicable regulations, no ATM withdrawals will be available.
4.10. Your Card must not be used for any illegal purpose or in any manner prohibited by law.
4.11. The Available Balance on your Account will not earn any interest.
4.12. We may request you to surrender the Card at any time for any good reason in accordance with the provisions in clause 17 of this Agreement. Where we do so, and provided that you are eligible and we are permitted by law, then we will give you back your Available Balance in accordance with clause 9 of this Agreement (free of redemption fee charge).
4.13. For Cardholders under 18 years of age the following applies:
4.13.1. A parent or legal guardian must accept the terms and conditions for the Card by contacting Customer Services. An additional Card may be provided, at our discretion, to any individual who is at least 13 years old.
4.13.2. Cards must not be used for any purpose for which the Cardholder has not attained the minimum age, for example gambling, adult entertainment and purchase of alcohol or any other purpose prohibited by any law.
4.13.3. We will monitor activity on Cards issued to Cardholders under 18 years of age. Any use of the Card which is considered to be unlawful or illegal may result in the Account being suspended in accordance with clause 17.3.
4.13.4. We reserve the right to request for such proof of age at any time. Failure to provide satisfactory proof of age may also result in the Account being suspended and/or the Agreement being rescinded without notice.
4.14. You may not use your Card to purchase any of the following for business purposes or for resale: tobacco products; postage stamps; infant formula; gift vouchers or cards; mobile phone top up vouchers or cards; spirits or fuel.
4.15. The maximum number of Contactless purchase Transactions that can be made consecutively before you are required to enter your PIN is ten. If we amend this limit we will notify you and post the change on the Website.
4.16. You can check your Available Balance and Transaction history at any time by logging into the Clubhouse or App.
4.17. You will either receive your monthly Account statements by post with your utility bill, or if you have £150 left within opted out of receiving a paper utility bill, Utility Warehouse will make your credit limit and we give a hotel authorisation for a payment of £100, we cannot allow more than £50 monthly Account statement available in your Clubhouse account. Utility Warehouse will email you each month to be spent on the notify you that your Clubhouse account unless the hotel cancels the authorisation;
(d) during the validity period embossed on the card; and
(e) by the cardholder solely as your agenthas been updated.

Using Your Card. 4.1 You can use your card at those retailers listed on the website. We can issue reserve the right to add or remove retailers from this list, as notified on the website. Removing retailers is not regarded as a change in these Terms and Conditions; such changes are out of our control. It is your responsibility to ensure that the balance on your card is greater than or is equal to the value of the purchase you are intending to make. Please call our IVR system on 0330 123 1106 to check your balance. If you wish to use your card in store for a purchase which, including any applicable fees, is greater in value than the balance on your card, you must tell the retailer to charge only up to the available balance on your card and that you will pay the difference by other means (such as another card / cash). It is at the retailer's discretion to allow part payments. We and the retailer will treat any transaction as genuine and made by you when: • Your card has been used in store, especially when your signature was confirmed on the receipt; • If available on your card, you have used the contactless payment facility on your card for payment in store; • Your card security details, only known to you, were used when paying with your card online or over the phone. Any transaction will be noted against your balance immediately but may remain in pending status until the retailer settles the payment. During the time that a payment is pending you cannot use these funds. It is up to the retailer how long funds are kept in pending status. Any fees (see Fees and Charges) will be taken from your card balance when they become payable. You will not be charged a card usage fee for domestic transactions. You cannot stop any transactions once made. However, any transaction that is agreed by a retailer to take place on a future date (after the date you authorise the transaction) may be withdrawn. To withdraw a transaction, you need to give the retailer at least one (1) full business day notice of your intent, providing a copy of this notice to us. We may charge you the Administration Fee for this (see Fees and PIN for use by any individual nominated by you as a cardholder Charges). If your available balance is not enough to cover the amount of the card account.
4.2 The card must be signed by transaction plus any applicable fees (see Fees and Charges), the cardholder immediately on receipt and can only be used:
(a) by that cardholder;
(b) subject to the terms of this agreement and not for any illegal purpose;
(c) within the credit limit (any excess over the credit limit payment transaction will be immediately repayable declined; unless: • Some retailers require you to us). When working out whether pre-authorise a transaction you want to make payment before the value of the final bill is within your credit limit, we take account of transactions we have already authorised but have not yet charged to the accountknown. For example, restaurants or hotels may ring-fence a balance greater than the expected final bill on your card and then settle the actual final bill later, without checking the balance available at that time again. Once the retailer has ring-fenced the expected bill balance, these funds will not be available for you to use until the final bill is settled. If the final bill is less than the expected bill, it may take up to fifteen (15) days for the difference to be added back to your card. The retailer determines the length that any ring-fenced balance is kept after the final bill is settled. If the final bill is larger than the pre-authorised amount, this may result in your card going into negative balance. • Certain retailer websites will also send pre-authorisation request to check if there are suffice funds available on your card to cover the value of your order, even when this order is not finalised yet or when you have £150 left within not proceeded to checkout. Here too the retailer may not check the available balance before settling the final payment, resulting in funds either remaining in a ring-fenced status or resulting in your credit limit and card going into negative balance. We may refuse to execute a transaction: • If we reasonably suspect that your card is being used in an unauthorised, fraudulent, or grossly negligent manner; • Or if we believe that an attempted or intended transaction would be unlawful. If we refuse to authorise a transaction we will give a hotel authorisation you the reason for a payment of £100the refusal, if practicable (unless it would be unlawful for us to do so). 4.5 value available on your Card. You are responsible for each cardholder’s all transactions initiated by use of the account, including your Card. If you permit someone else to use that makes your Card we will treat this as if you break this agreement. For example if a cardholder makes a transaction that takes you over the credit limit, have authorized such use and you will be responsible for repaying that sum any transactions made subject to such use. If you do not have enough value loaded on your Card you can instruct the merchant to charge a part of the purchase to the Card and pay the remaining amount with cash or another card. These are called “split transactions”. Some merchants do not allow cardholders to conduct split transactions. Some merchants will only allow you to do a split transaction if you pay the remaining amount in cash. If you use your Card number without presenting your Card (including any chargessuch as for a mail order or telephone purchase), the legal effect will be the same as if you used the Card itself. For security reasons, we may limit the amount or number of transactions you can make on your Card. Your Card cannot be redeemed for cash. You may use your Card to access cash at an Automated Teller Machine (ATM). We’ll cancel the card when you tell us to, but you should also take reasonable steps to recover and destroy the card. We don’t have an agreement with You may not use your Card for any cardholder so we cannot give them information about the account.
4.6 Some cash machines operated by other financial organisations may charge you; please check before using them.
4.7 We’ll debit your card account with the amounts of all card illegal transactions, any other liabilities of the cardholder use at casinos, and any loss incurred by us arising from the use of the cardgambling activity. Using Your Card. 4.1 We can issue 5.1 The Card may only be used in all Visa Inc. Participating Retailers’ organizations. Participating Retailers may change from time to time. Some Participating Retailers might not accept your Card due to their internal operational reasons. You will receive a card and PIN for use by any individual nominated by notification via SMS notifying you as when a cardholder of the card accountParticipating Retailer declines your Card.

5.3 You shall be responsible for ensuring the correctness and accuracy of all purchases made with the Card. This is set out Any loss due to negligence of usage of your Card will not be covered by us.
5.4 We will immediately debit the amount in the Charge M-PESA Account for all Purchases from your Card. If you attempt to spend more than the amount on your M- PESA Account balance, your transaction will be declined. Each time you transact, you will receive an SMS confirmation notifying you of the success or failure of that transaction.
5.5 You must not use the Virtual Card:
5.5.1 After this Agreement has been terminated; or the Card Tariff expirer date has passed or
5.5.2 For payment of any illegal purchase.
5.6 You can stop a Card Purchase after it has been authorized by requesting the Participating Retailer to stop it. You may also request the Participating Retailer for reversal or refund. 5.7 We will issue Card statements upon request. Statements will be available on SMS or App as well as within your M-PESA Statements.
5.8 You are responsible for monitoring your M-PESA Account balance and for ensuring that there are always enough Funds on the Card to pay for Card Purchases at Participating Retailers.
5.9 You are responsible for all authorized transactions on the Card. We are not liable for any losses arising from any authorized transactions that occur due to carelessness, ignorance, theft or misuse of your Card. As soon as you can discover or suspect that your Card credentials are compromised or there are unauthorized transactions on your Card you shall notify us immediately. We shall not be liable for transactions that occur due to carelessness, ignorance, theft or misuse of your Card.
5.10 You agree that online Card payments are subject to all laws and regulations including any exchange rate control regulations. You may therefore be required to pay the Participating Retailers at the prevailing exchange rate which may fluctuate before settlement or completion of payment and shipment.
5.11 Once you have notified us of an unauthorized or incorrectly executed transaction on your Card, we will promptly investigate your claim. In some cases, we may ask you to give us further information about the transaction (for detailsinstance, to enable us to confirm that the transaction was properly authenticated). You agree to cooperate with law enforcement bodies if requested to do so.
5.12 In case you update your M-PESA KYC or change ownership of your M-PESA Account before a payment has been settled while it is still linked to the Card, it may impact the processing of that payment. If the final settlement amount exceeds your Account balance, the transaction will fail. You may be required to take additional steps such as performing multiple payments as long as you agree with the Participating Retailer to accept having to make multiple payments.
5.13 In case a Card payment is not successfully completed, we reserve the right to later debit from your M-PESA Account, the equivalent of any amount transacted by you (including Fees) in exchange for unpaid goods or services purchased and released to you by a Participating Retailer.
5.14 We reserve the right to suspend your Card in case we receive a valid complaint from a Participating Retailer until such complaint is resolved.
5.15 We will not be liable for defects or fraud or poor goods or services by a Participating Retailer. We will also not be liable for payments made to an unintended recipient using your Card. Any queries or complaints about such goods or services should be addressed to the relevant Participating Retailer(s).
5.16 Should you fail to reach an amicable agreement with the Participating Retailer, you may contact Customer Care or visit our retail shops where you may lodge a dispute. Customer Care will guide you on any forms or details required to be filled in order to correctly lodge the dispute. On receipt of a duly lodged dispute form, we will contact Visa for resolution. The expected time period for resolution of a dispute between you and the Participating Retailer is forty- five (45) working days.
5.17 A dispute between you and a Participating Retailer will not affect or stop any initiate transactions from completion and Safaricom will not:

Using Your Card. 4.1 We 4.1. Your Card can issue be used at any Merchant that displays the Visa Mark, excluding limited acceptance Merchants in EU/EEA that do not accept prepaid cards (fees apply, see clause 13).
4.2. You can use your Card to make purchases in-store, via the internet or over the phone. The Card cannot be used to obtain cash back from Merchants, foreign currency, travellers’ cheques, to settle outstanding balances on credit cards, bank overdrafts or credit agreements, to pay for recurring Transactions or for gambling and betting Transactions.
4.3. When your Card is used to make a card and PIN for use by any individual nominated Transaction with a Merchant we will regard it as authorised by you as a cardholder when you enter your PIN or other security code, or in the case of Contactless purchase Transactions, when your Card is tapped at the point of sale terminal in the Merchant’s store. If the Merchant does not accept chip and PIN, or Contactless authorisations, the Merchant may allow you to authorise the Transaction by signature of the card accountreceipt. On authorisation of the Transaction we will receive notification to proceed with it and we will not be able to stop it. You will be responsible for all Transactions that you and the additional Cardholders authorise, regardless of the manner of such authorisation. We may refuse to execute a Transaction if the Transaction is unlawful or fraudulent and/or you do not have sufficient Available Balance. If we refuse to execute a Transaction, you can check the Account to ensure there was enough Available Balance to cover the Transaction, or can ask us why we have not executed a Transaction by contacting Customer Services. Unless the law prevents us, we will explain why and we will also tell you what you can do to correct any errors in the Transaction. You will be responsible for all Transactions where you or any additional Cardholders authorise such Transaction, regardless of the manner of such authorisation.
4.2 The card must 4.4. Your Card is a prepaid Card, which means that the Available Balance will be signed reduced by the cardholder immediately full amount of each Transaction and authorisation, plus any taxes and charges that are applicable.
4.5. You must not use your Card if the Full Deductible Amount exceeds the Available Balance. If, for any reason, a Transaction is processed for an amount greater than the Available Balance on receipt and can your Card, Utility Warehouse will attempt to collect a sufficient amount to bring your balance back up to £0, from your next monthly bill, unless prohibited by law. Should you not repay this amount within 14 days of receiving the invoice, Utility Warehouse reserve the right to take all steps necessary, including legal action, to recover any monies outstanding.
4.6. Due to security safeguards, Merchants that accept your Card are required to seek authorisation from us for all Transactions you make. There are some circumstances where Merchants may require you to have an Available Balance greater than the value of the Transaction you wish to make. You will only be usedcharged for the actual and final value of the Transaction you make. Merchants request this as they may need to access more funds than you initially planned to spend. For example:
(a) by 4.6.1. Hotels, rental cars, and restaurants – as Merchants may not be able to accurately predict how much your final bill will be, they may request an authorisation of funds greater than your Available Balance.
4.6.2. Internet Merchants - certain internet Merchant sites will, on registration or at checkout stage, send a request for payment authorisation to verify if funds are available; this will temporarily impact your Available Balance. Also please bear in mind that cardholder;
(b) subject to the terms many sites will not deduct payment until goods are dispatched so please be aware of this agreement when checking your balance and ensure that you always have sufficient funds to cover your purchases.
4.6.3. Your Card cannot be used in situations where it is not possible to obtain online authorisation that you have sufficient balance for any illegal purpose;
(c) within the credit limit (any excess over the credit limit will be immediately repayable to us). When working out whether a transaction you want to make is within your credit limit, we take account of transactions we have already authorised but have not yet charged to the accountTransaction. For example, Transactions on trains, ships, in flight purchases and remote terminals designed for rapid low value Transactions (e.g. motorway tolls).
4.7. If a Merchant agrees to give you a refund for a purchase made using your Card, we will transfer the refund into your Account when we receive details of it from the Merchant.
4.8. Your Card should not be used as a form of identification. We will decline any authorisation requests from Merchants using your Card for identification purposes.
4.9. You may use your Card to obtain cash worldwide from any machine that displays the Visa mark. There is a daily cash withdrawal limit of £250 (or equivalent in a foreign currency) per Account however the cash machine provider may have a reduced limit and may charge additional fees. Transaction fees apply (see clause 13). Until we have verified your identity in accordance with applicable regulations, no ATM withdrawals will be available.
4.10. Your Card must not be used for any illegal purpose or in any manner prohibited by law.
4.11. The Available Balance on your Account will not earn any interest.
4.12. We may request you to surrender the Card at any time for any good reason in accordance with the provisions in clause 17 of this Agreement. Where we do so, and provided that you are eligible and we are permitted by law, then we will give you back your Available Balance in accordance with clause 9 of this Agreement (free of redemption fee charge).
4.13. For Cardholders under 18 years of age the following applies:
4.13.1. A parent or legal guardian must accept the terms and conditions for the Card by contacting Customer Services. An additional Card may be provided, at our discretion, to any individual who is at least 13 years old.
4.13.2. Cards must not be used for any purpose for which the Cardholder has not attained the minimum age, for example gambling, adult entertainment and purchase of alcohol or any other purpose prohibited by any law.
4.13.3. We will monitor activity on Cards issued to Cardholders under 18 years of age. Any use of the Card which is considered to be unlawful or illegal may result in the Account being suspended in accordance with clause 17.3.
4.13.4. We reserve the right to request for such proof of age at any time. Failure to provide satisfactory proof of age may also result in the Account being suspended and/or the Agreement being rescinded without notice.
4.14. You may not use your Card to purchase any of the following for business purposes or for resale: tobacco products; postage stamps; infant formula; gift vouchers or cards; mobile phone top up vouchers or cards; spirits or fuel.
4.15. To help protect you from fraud when using contactless payments, we will prompt you to enter your PIN from time to time.
4.16. You can check your Available Balance and Transaction history at any time by logging into the Clubhouse or App.
4.17. You will either receive your monthly Account statements by post with your utility bill, or if you have £150 left within opted out of receiving a paper utility bill, Utility Warehouse will make your credit limit and we give a hotel authorisation for a payment of £100, we cannot allow more than £50 monthly Account statement available in your Clubhouse account. Utility Warehouse will email you each month to be spent on the notify you that your Clubhouse account unless the hotel cancels the authorisation;
(d) during the validity period embossed on the card; and
(e) by the cardholder solely as your agenthas been updated.

Using Your Card. 4.1 18.3.1 You may use your card along with the relevant PIN to obtain cash (up to the daily limit for your card, subject to remaining within your Facility limit) from any cash machine which we advise will accept your card.
18.3.2 We will advise you of the daily cash withdrawal limit (this may include the value of other transactions carried out at cash machines, details of which will be advised to you from time to time) and we may adjust the limit from time to time. This limit applies to both domestic and international withdrawals.
18.3.3 You can issue use your debit card to make purchases from retailers or suppliers of services, the use of our card will have the effect of guaranteeing the payment and we will be obliged to pay the sum due to the retailer or supplier.
18.3.4 If by using your card you (or with a joint Account either of you) instruct us to increase the borrowing on your Account to more than the agreed Facility taking into account any other transactions we have authorised that we have not yet applied to the Account then we will treat the card transaction as an informal request to allow the agreed Facility to be exceeded and the provisions set out in Condition 2 will apply.
18.3.5 If you have a joint Account, although you will both have your own cards, you are each responsible for all transactions carried out using the cards and for repayment of any borrowing which arises on your Account.
18.3.6 Cash withdrawals using your card and PIN for use authorised payments made using your card will be applied to your Account on the day the transaction is carried out or on the next business day.
18.3.7 On each business day, any available funds on your Account will be used to pay any transaction notified to us since the previous business day before they will be used to pay any other debit from your Account.
18.3.8 When there is a transaction in a foreign currency on your Account, we will convert it into Sterling at our then current exchange rate.
18.3.9 You must pay all amounts charged to your Account by any individual nominated by your card (even when the details on the sales voucher are wrong or where no sales voucher is signed) if it is clear that you as a cardholder have authorised the transaction.
18.3.10 When we receive an acceptable refund voucher we will pay the amount of the card refund to your account.
4.2 The card 18.3.11 You (and with a joint Account each of you) must be signed by the cardholder immediately on receipt and can only be usednot use your cards:
(a) by that cardholder;before or after the period it is valid for; or
(b) subject to after we tell you that we have suspended, cancelled or withdrawn the terms use of this agreement and not for any illegal purposeyour cards under Condition 18.3.14;
(c) within the credit limit (any excess over the credit limit will be immediately repayable after we have demanded that you return your card to us). When working out whether a transaction you want to make is within your credit limit, or we take account of transactions we (or someone acting for us) have already authorised but have not yet charged to kept the account. For example, if you have £150 left within your credit limit and we give a hotel authorisation for a payment of £100, we cannot allow more than £50 to be spent on the account unless the hotel cancels the authorisationcard under Condition 18.3.16;
(d) during if we receive notice of the validity period embossed on the card; andloss, theft or possible misuse of your card under Condition 18.3.17;
(e) by the cardholder solely as if your agentright to use your card is ended under Condition 18.7.
4.3 The card remains our property and you must return 18.3.12 We may suspend, withdraw or restrict the use of your cards for any cards promptly if we ask you to.
4.4 You, and any cardholder, may use the account for of the following types of transactionreasons:
(a) To make a purchase.we have reasonable grounds to suspect that your card details have not been kept safe; or
(b) To get cash we have reasonable grounds to suspect unauthorised or make fraudulent use of your card; or
(c) you have broken the terms of the Agreement you have with us; or
(d) as a cash-related payment result of a change in the way you operate your Account or in your financial circumstances we have reasonable grounds to believe that you may have difficulty in meeting your commitments; or
(such e) we have sent you a replacement card; or
(f) we consider it appropriate for your protection. Unless we are unable to contact you or there is a legal reason or other circumstances beyond our control preventing us from doing so, we will notify you personally before taking this action and provide our reasons for doing so. If we are unable to contact you beforehand, we will notify you and give our reasons afterwards.
18.3.13 When we issue you with a replacement card, we may issue it under a different card scheme. We will only do this if we reasonably believe that the facilities offered by a card issued under the new scheme will, on balance, be as buying traveller’s cheques or foreign currency, placing a bet (or making other gambling payments)good as, or buying money ordersbetter than, those offered by your previous card.
18.3.14 Your cards remain our property. At any time when Condition 18.3.14 allows us to suspend, withdraw or restrict the use of your card, we may instead give you personal notice demanding that you return your card to us. If we do this, then:
(a) you must return your cards to us immediately (cut once through the magnetic strip and once through the chip) and
(b) we, or anyone acting for us, may keep your cards at any time if you try to use it.
18.3.15 Once we receive notice of the loss, theft or possible misuse of your card, we will cancel your card. If your card is then found, you must not use it. You must return it to us immediately (cut once through the magnetic strip and once through the chip).
4.5 You are responsible for each cardholder’s use of 18.3.16 We will not be liable if any party refuses to let you pay or withdraw cash using your card.
18.3.17 By inserting your card in the account, including use that makes you break this agreement. For example if a cardholder makes a transaction that takes you over the credit limitcard reader device provided and keying in your PIN, you may use your card to authenticate transactions for which you have given instructions in a branch or at a retail outlet.
18.3.18 Details of card transactions will be responsible for repaying that sum (including any charges). We’ll cancel the card when you tell us to, but you should also take reasonable steps to recover and destroy the card. We don’t have an agreement with any cardholder so we cannot give them information about the accountshown on your monthly statement.

(a) by that cardholderi. if We are concerned about the security of Your Card;
(b) subject to the terms ii. if We suspect that Your Card is being used in an unauthorised, fraudulent or grossly negligent manner;
iii. if You break an important term of this agreement Agreement, or repeatedly break any term in this Agreement and not following notice fail to resolve the matter in a timely manner; or
iv. if We need to do so to comply with applicable law.
k) If We suspend, restrict or cancel Your Card or refuse to issue or replace Your Card for any illegal purpose;

4.7 We’ll debit your card account with the amounts of all card transactions, any other liabilities of the cardholder and any loss incurred by us arising from the use of the card. You must pay us all amounts debited whether or not the cardholder signs a sales or cash advance voucher.
4.8 We convert into sterling cover the amount of the transaction and any card applicable fees; or
iii. if We believe that an attempted or intended transaction in a currency other than sterling using a reference rate set by VISA which is available on their websitewill break applicable law.
4.9 m) If We can charge refuse to authorise a transaction, We will, if practicable, tell You why unless it would be unlawful for converting Us to do so. You may correct any information We hold (which may have caused Us to refuse a transaction) by contacting Card Services.
n) We cannot guarantee that in every given situation a Merchant will accept Your Card. In all cases, Merchants should check that Your Available Funds will cover the amount transaction amount.
o) In some circumstances We (or a Merchant) may require You to have Available Funds in excess of a card the transaction into sterlingamount. ii. when Your Card is used to purchase fuel at an automated fuel pump, it must have a minimum credit of typically between £10 to £50 or currency equivalent. If Your actual transaction is less than the additional amount added or You spend less than the minimum credit amount, it may take up to seven (7) Business Days from the date of the transaction before the difference is available to spend. p) Some Merchants including, but not limited to, hotel and rental car operators – Merchants such as these may not be able to accurately predict how much Your final bill will be, in some cases they may request an authorisation for funds greater than Your Available Balance. We suggest that You consider using an alternative prepaid or credit card for pre-authorisations and using Your Card when checking out of the hotel or paying Your final car hire bill. You will not be charged twice by the hotel or car hire company.
q) Some Merchants including, but not limited to, internet Merchants – Some such Merchant’s websites will, on registration or at checkout stage, send a request for payment authorisation to verify if funds are available. This will temporarily impact Your Available Balance. Also please bear in mind that many websites will not deduct payment until goods are dispatched, so please be aware of this when checking Your balance to make sure You always have sufficient funds available to cover Your purchases.

If, for any reason, a transaction is processed for an amount greater than the Available Balance on your Card, you must repay us the amount by which the Full Deductible Amount exceeds your Available Balance immediately after receiving an invoice from us. For example, if 5.2 Once you have £150 left within your credit limit and we give a hotel authorisation for authorised a payment of £100from your Account, we cannot allow more than £50 change or cancel it. We cannot cancel authorised payments that have not yet been processed. You may be able to cancel transactions that you have authorised for a future date (including recurring transactions) by contacting the retailer before the date on which the payment is due to be spent on made.
5.3 Your Card is a prepaid card, which means that the account unless the hotel cancels the authorisation;
(d) during the validity period embossed on the card; and
(e) Available Balance will be reduced by the cardholder solely full amount of each transaction and authorisation, plus any applicable taxes and charges, including additional ATM charges if any. You must not use your Card if the Full Deductible Amount exceeds the Available Balance. If, for any reason, a transaction is processed for an amount greater than the Available Balance on your Card, you must repay us the amount by
5.4 Due to security safeguards, Merchants that accept your Card are required to seek authorisation from us for all of the transactions that you make. There are some circumstances where Merchants may require you to have an Available Balance greater than the value of the transaction you wish to make. You will only be charged for the actual and final value of the transaction you make. Merchants request this as they may need to access more funds than you initially planned to spend. For example:
5.4.1 hotels, rental cars, and restaurants – as Merchants may not be able to accurately predict how much your agentfinal bill will be, they may request an authorisation for funds greater than
5.4.2 internet Merchants – certain internet Merchant sites will, on registration or at checkout stage, send a request for payment authorisation to verify if funds are available. This will temporarily impact your Available Balance. Also please bear in mind that many sites will
5.5 Your Card cannot be used in situations where it is not possible to obtain online authorisation that you have sufficient balance for the transaction. For example: transactions on trains, ships, and some inflight purchases.
4.3 5.6 Your Card cannot be used at self service petrol pumps. You can use your Card to pay by taking it to the cashier.
5.7 Your Card should not be used as a form of identification.
5.8 Your Card may not be used for any illegal purpose or in any manner prohibited by law.
5.9 The card remains our property and you must return Available Balance on your Account will not earn any cards promptly if we interest.
5.10 We may ask you toto surrender the Card at anytime for a valid reason in accordance with the provisions in paragraph 17 of this Agreement. If we do so, we will give you back your Available Balance in accordance with paragraph 9 of this Agreement.
4.4 You, and any cardholder, may use 5.11 You can also set up payment instructions on My Account to load Cards belonging to other people. It is your responsibility to ensure that all the account for details that you have entered are correct. Once you have set up the following types of transaction:

4.5 You are responsible for each cardholder’s use of the account, including use that makes you break this agreement. For example if a cardholder makes a transaction that takes you over the credit limitinstructions on My Account, you will be responsible for repaying that sum (including any charges). We’ll cancel the card when you tell us to, but you should also take reasonable steps able to recover and destroy the card. We don’t have an agreement with any cardholder so we cannot give amend them information about the accountas necessary.
4.6 Some cash machines operated by other financial organisations may charge you; please check before 5.12 If a retailer agrees to give a refund for a purchase made using them.
4.7 We’ll debit your card account with Card, we will make the amounts of all card transactions, any other liabilities of refund when we receive the cardholder and any loss incurred by us arising funds from the use of the card. You must pay us all amounts debited whether or not the cardholder signs a sales or cash advance voucherretailer.
4.8 We convert into sterling the amount of any card transaction in a currency other than sterling using a reference rate set by VISA which is available on their website.
4.9 We can charge for converting the amount of a card transaction into sterling. This is set out in the Charge Card Tariff or you can ask us for details.

Using Your Card. 4.1 We can issue a card 7.1 Subject to these Terms and PIN for Conditions, you may use by any individual nominated by you as a cardholder of the card account.
4.2 The card must be signed by the cardholder immediately on receipt and can only be used:
your Card to purchase goods or services (aup to your Credit Limit) by that cardholder;
(b) subject to the terms way of this agreement and not for any illegal purpose;
(c) within the credit limit (any excess over the credit limit will be immediately repayable to us)EFTPOS. 7.2 Subject to these Terms and Conditions and to the cardfacilities enabling Finance Now to provide you with cash withdrawals being established, you may use your Card to withdraw cash from ATMs.
7.3 Different EFTPOS Terminals and ATMs have different maximum and minimum transaction limits. We may also set maximum and minimum transaction and daily limits for cash withdrawals and EFTPOS transactions. We will advise you of any maximum or minimum limits set by us.
7.4 We may decline any transaction using your Card which would cause your Finance Now Card Facility to exceed your Credit Limit.
7.5 Where you are, or have been, in arrears in repayment of any amount due under your Finance Now Card Facility for 10 days or more, we may decline any transaction using your Card until you cease to be in arrears and we have expressly approved further transactions.
7.6 Unless fraud or gross negligence occurs, you agree that an amount shown on an EFTPOS Receipt or ATM Receipt is conclusive evidence of the price of the goods or services, or the amount of your cash withdrawal, as the case may be, and is the amount of the advance made by us under your Finance Now Card Facility and debited to your Account (plus any commissions or fees negotiated between us and the merchant or financial institution that may be applicable).
7.7 We are not responsible for any decision by any merchant not to accept your Card or any decision by any merchant to refuse to supply you with goods or services using your Card or to impose limits or conditions on the use of your Card. You must pay us all amounts debited whether or not resolve any disputes in this regard directly with the cardholder signs a sales or cash advance vouchermerchant.
4.8 7.8 We convert into sterling are not responsible for (including as to the amount of ongoing provision of), and give no warranty for, any card transaction in goods or services which you obtain from a currency other than sterling merchant using a reference rate set your Card, except as required by VISA which is available on their websitelaw. You must resolve any complaints directly with the merchant.
4.9 7.9 Any refund to you by a merchant is a matter of agreement between you and the merchant only. We can are not responsible for providing any refund except as required by law.
7.10 We are not responsible, and give no warranty, for any loss whether direct or indirect which you incur through using your Card in an EFTPOS Terminal or an ATM. In addition to these Terms and Conditions, the use of your Card in any EFTPOS Terminal or ATM is subject to the conditions imposed from time to time by merchants and, in the case of an ATM, the relevant financial institution responsible for that ATM. Access to any EFTPOS Terminal or ATM is at the relevant merchant’s and/or the financial institution’s sole discretion. They may make a charge for converting such access, which you authorise us to debit to your Account at our discretion.
7.11 We will send you statements in relation to your Finance Now Card Facility in accordance with the amount of a card transaction into sterling. This is continuing disclosure obligations set out in the Charge Card Tariff Disclosure Statement. These will be available online, or will be sent to you via email or to your last known address, unless there have been no transactions during the statement period and the total Closing Balance is nil or you have breached these Terms and Conditions and we have commenced enforcement proceedings. Your statement will show all amounts debited and credited to your Account during the statement period.
7.12 If you believe an EFTPOS Receipt, ATM Receipt or continuing disclosure statement is incorrect in any respect you must notify us immediately by calling our Customer Services Centre on 0800 FNL CARD (0800 365 2273). We will provide you with a transaction dispute form to complete, or you can ask us for detailssubmit the details of a disputed transaction on our website.
7.13 EFTPOS and ATM transactions will be debited to your Account on the day the transaction is made, or as soon as possible thereafter, subject to our right to vary the date of debiting due to circumstances beyond our control. When you use your Card in an EFTPOS Terminal or ATM, the transaction will be processed as soon as we receive notification of the electronic funds device you used.

Using Your Card. 4.1 We 4.1. Your Card can issue be used at any Merchant that displays the Visa Mark, excluding limited acceptance Merchants in EU/EEA that do not accept prepaid cards (fees apply, see clause 13).
4.2. You can use your Card to make purchases in-store, via the internet or over the phone. The Card cannot be used to obtain cash back from Merchants, foreign currency, travellers’ cheques, to settle outstanding balances on credit cards, bank overdrafts or credit agreements, to pay for recurring Transactions or for gambling and betting Transactions.
4.3. When your Card is used to make a card and PIN for use by any individual nominated Transaction with a Merchant we will regard it as authorised by you as a cardholder when you enter your PIN or other security code, or in the case of Contactless purchase Transactions, when your Card is tapped at the point of sale terminal in the Merchant’s store. If the Merchant does not accept chip and PIN, or Contactless authorisations, the Merchant may allow you to authorise the Transaction by signature of the card accountreceipt. On authorisation of the Transaction we will receive notification to proceed with it and we will not be able to stop it. You will be responsible for all Transactions that you and the additional Cardholders authorise, regardless of the manner of such authorisation. We may refuse to execute a Transaction if the Transaction is unlawful or fraudulent and/or you do not have sufficient Available Balance. If we refuse to execute a Transaction, you can check the Account to ensure there was enough Available Balance to cover the Transaction, or can ask us why we have not executed a Transaction by contacting Customer Services. Unless the law prevents us, we will explain why and we will also tell you what you can do to correct any errors in the Transaction. You will be responsible for all Transactions where you or any additional Cardholders authorise such Transaction, regardless of the manner of such authorisation.
4.2 The card must 4.4. Your Card is a prepaid Card, which means that the Available Balance will be signed reduced by the cardholder immediately full amount of each Transaction and authorisation, plus any taxes and charges that are applicable.
4.5. You must not use your Card if the Full Deductible Amount exceeds the Available Balance. Should you not repay this amount within 14 days of receiving the invoice, UW reserve the right to take all steps necessary, including legal action, to recover any monies outstanding.

(b) subject to the terms many sites will not deduct payment until goods are dispatched so please be aware of this agreement when checking your balance and ensure that you always have sufficient funds to cover your purchases.
4.6.3. Your Card cannot be used in situations where it is not possible to obtain online authorisation that you have sufficient balance for any illegal purpose;
(c) within the credit limit (any excess over the credit limit will be immediately repayable to us). When working out whether a transaction you want to make is within your credit limit, we take account of transactions we have already authorised but have not yet charged to the accountTransaction. For example, Transactions on trains, ships, in flight purchases and remote terminals designed for rapid low value Transactions (e.g. motorway tolls).
4.7. If a Merchant agrees to give you a refund for a purchase made using your Card, we will transfer the refund into your Account when we receive details of it from the Merchant.
4.8. Your Card should not be used as a form of identification. We will decline any authorisation requests from Merchants using your Card for identification purposes.
4.9. You may use your Card to obtain cash worldwide from any machine that displays the Visa mark. There is a daily cash withdrawal limit of £250 (or equivalent in a foreign currency) per Account however the cash machine provider may have a reduced limit and may charge additional fees. Transaction fees apply (see clause 13). Until we have verified your identity in accordance with applicable regulations, no ATM withdrawals will be available.
4.10. Your Card must not be used for any illegal purpose or in any manner prohibited by law.
4.11. The Available Balance on your Account will not earn any interest.
4.12. We may request you to surrender the Card at any time for any good reason in accordance with the provisions in clause 17 of this Agreement. Where we do so, and provided that you are eligible and we are permitted by law, then we will give you back your Available Balance in accordance with clause 9 of this Agreement (free of redemption fee charge).
4.13. For Cardholders under 18 years of age the following applies:
4.13.1. A parent or legal guardian must accept the terms and conditions for the Card by contacting Customer Services. An additional Card may be provided, at our discretion, to any individual who is at least 13 years old.
4.13.2. Cards must not be used for any purpose for which the Cardholder has not attained the minimum age, for example gambling, adult entertainment and purchase of alcohol or any other purpose prohibited by any law.
4.13.3. We will monitor activity on Cards issued to Cardholders under 18 years of age. Any use of the Card which is considered to be unlawful or illegal may result in the Account being suspended in accordance with clause 17.3.
4.13.4. We reserve the right to request for such proof of age at any time. Failure to provide satisfactory proof of age may also result in the Account being suspended and/or the Agreement being rescinded without notice.
4.14. You may not use your Card to purchase any of the following for business purposes or for resale: tobacco products; postage stamps; infant formula; gift vouchers or cards; mobile phone top up vouchers or cards; spirits or fuel.
4.15. To help protect you from fraud when using contactless payments, we will prompt you to enter your PIN from time to time.
4.16. You can check your Available Balance and Transaction history at any time by logging into the Clubhouse or App.
4.17. You will either receive your monthly Account statements by post with your utility bill, or if you have £150 left within opted out of receiving a paper utility bill, UW will make your credit limit and we give a hotel authorisation for a payment of £100, we cannot allow more than £50 monthly Account statement available in your Clubhouse account. UW will email you each month to be spent on the notify you that your Clubhouse account unless the hotel cancels the authorisation;
(d) during the validity period embossed on the card; and
(e) by the cardholder solely as your agenthas been updated.
4.3 The card remains our property and you must return any cards promptly if we ask you to.

Using Your Card. 4.1 We a) You can issue a card use the Your Card at any retailer (both online and PIN for use by any individual nominated by you as a cardholder of on the card accounthigh street) wherever the Mastercard® Acceptance Mark is shown, subject to the restrictions set out in this Agreement.
4.2 The card b) You will not be able to use Your Card to set up a recurring payment or regular subscriptions.
c) You will not be able to use Your Card after its expiry date.
d) Before using Your Card You must ensure there are sufficient Available Funds.
e) Spending limits may apply to Your Card, see the Fees and Limits Section below for full details.
f) All payments made using Your Card shall be signed by in the cardholder immediately on receipt and Denominated Currency.
g) Your Card can only be usedused to pay for good or services in the UK and online in the Denominated Currency.
h) We will deduct the value of Your transaction(s) from the Available Funds on Your Card as soon as the transaction is made. We will also deduct any applicable fees as soon as they become payable by You, see the Fees and Limits Section below for full details..
i) Your Card may not be used for illegal transactions, to buy illegal goods or services.
j) The Card belongs to Us. We may at any time suspend, restrict or cancel Your Card or refuse to issue or replace a Card for reasons relating to the following:
(a) by that cardholderi. if We are concerned about the security of Your Card;
(b) subject to the terms ii. if We suspect that Your Card is being used in an unauthorised, fraudulent or grossly negligent manner;
iii. if You break an important term of this agreement Agreement, or repeatedly break any term in this Agreement and not following notice fail to resolve the matter in a timely manner; or
iv. if We need to do so to comply with applicable law.
k) If We suspend, restrict or cancel Your Card or refuse to issue or replace Your Card for any illegal purpose;
(c) within the credit limit (any excess over the credit limit reason, We will be immediately repayable tell You as soon as We reasonably are able to us)do so or are permitted to do so. When working out whether In some cases We may ask You to stop using Your Card and return it to Us or destroy it. We may issue You with a transaction you want replacement Card if after further investigations We believe that it is safe to make is within your credit limit, we take account of transactions we have already authorised but have not yet charged to the account. For example, if you have £150 left within your credit limit and we give a hotel authorisation for a payment of £100, we cannot allow more than £50 to be spent on the account unless the hotel cancels the authorisation;
(d) during the validity period embossed on the card; and
(e) by the cardholder solely as your agentdo so.

For example if a cardholder makes a transaction that takes you over the credit limit, you will be responsible for repaying that sum (including any charges). We’ll cancel the card when you tell us to, but you should also take reasonable steps to recover and destroy the card. We don’t have an agreement with any cardholder so we cannot give them information about the account.
4.6 Some cash machines operated by other financial organisations may charge you; please check before using them.
4.7 We’ll debit your card account with the amounts of all card transactions, any other liabilities of the cardholder and any loss incurred by us arising from the use of the card. You must pay us all amounts debited whether or not the cardholder signs a sales or cash advance voucher.
4.8 We convert into sterling cover the amount of the transaction and any card applicable fees; or
iii. if We believe that an attempted or intended transaction in a currency other than sterling using a reference rate set by VISA which is available on their websitewill break applicable law.
4.9 m) If We can charge refuse to authorise a transaction, We will, if practicable, tell You why unless it would be unlawful for converting Us to do so. You may correct any information We hold (which may have caused Us to refuse a transaction) by contacting Card Services.
n) We cannot guarantee that in every given situation a Merchant will accept Your Card. In all cases, Merchants should check that Your Available Funds will cover the amount transaction amount. For Your information it is important to note that some transactions for the Your Card may not be allowed by some types of merchants, including but not limited to casinos, online gaming sites, betting shops, dating and escort services or massage parlours.
o) In some circumstances We (or a card Merchant) may require You to have Available Funds in excess of the transaction into sterlingamount. This is set to ensure there are sufficient funds available to cover the final cost of the transaction and to reduce the risk of a negative balance arising on Your Card. Examples include:
i. when Your Card is used at certain Merchants including bars and restaurants, an additional amount (typically 10%-20%) is automatically added as an anticipated service charge or tip, temporarily reducing the Available Funds on Your Card; and/or
ii. when Your Card is used to purchase fuel at an automated fuel pump, it must have a minimum credit of typically between £10 to £50 or currency equivalent. If Your actual transaction is less than the additional amount added or You spend less than the minimum credit amount, it may take up to seven (7) Business Days from the date of the transaction before the difference is available to spend. Only the actual amount of the final bill agreed between You and the Merchant will be deducted from Your Card. For further information please refer to the FAQs on Our Website.
p) Some Merchants including, but not limited to, hotel and rental car operators – Merchants such as these may not be able to accurately predict how much Your final bill will be, in some cases they may request an authorisation for funds greater than Your Available Balance. This is called “pre-authorisation”. We suggest that You consider using an alternative prepaid or credit card for pre-authorisations and using Your Card when checking out of the hotel or paying Your final car hire bill. You will not be charged twice by the hotel or car hire company.
q) Some Merchants including, but not limited to, internet Merchants – Some such Merchant’s websites will, on registration or at checkout stage, send a request for payment authorisation to verify if funds are available. This will temporarily impact Your Available Balance. Also please bear in mind that many websites will not deduct payment until goods are dispatched, so please be aware of this when checking Your balance to make sure You always have sufficient funds available to cover Your purchases.
r) You can check Your Available Balance by calling Our automated balance service on 0330 123 2711.
s) You must not distribute, transfer or in any way provide Your Card to residents of India.
t) If You wish to return any goods purchased with Your Card You must follow the Charge Card Tariff or you can ask us for detailsMerchant’s procedures.
