Voluntary Transfers. 4.04.1 Members who desire a transfer to a posted vacancy shall contact the Human Resources Department, in writing, and shall be given consideration for that position provided that a contact has been made with the personnel office on or before the closing date. Assignments shall not be made until all interview requests have been considered. 4.04.4 In middle school and high school, the procedure for voluntary transfers shall also apply from December 1 until ten (10) days prior to the commencement of the second semester. 4.04.5 Voluntary transfers beyond the times specified require approval of the Assistant Superintendent, Human Resources/designee. 4.04.6 A request for a voluntary transfer shall not be denied arbitrarily. 4.04.7 If a request for a voluntary transfer is denied, the member shall be given, upon request, the specific reason(s) for the denial in writing.

Voluntary Transfers. 4.04.1 Members 4.4.1 Teachers may initiate their own transfer by submitting a written request to the District Superintendent or designee. 4.4.2 Applications for transfer may be submitted at any time during the District’s regular office hours. 4.4.3 A transfer application may be submitted in response to a particular opening that has been announced in the District or simply for purposes of receiving consideration for vacancies as they occur. If the applicant indicates that he/she wishes only to be considered for a particular opening, his/her application will become inactive once that opening is filled. Otherwise, the application will be kept open by the District for reference when vacancies occur until March 15th of that school year. 4.4.3.1 Teachers who desire wish to transfer to another site and/or grade level for the next school year should submit a transfer request letter to a posted vacancy the District as soon as possible after March 15th and prior to May 1st. The letter should be as specific as possible about the new assignment desired. Requests for transfer after May 1st will be taken by the District but will be considered for transfer within the staffing assignments that exist when the request is received. 4.4.4 The administration shall contact post notice of all known certificated vacancies as soon as they are authorized by the Human Resources Department, in writing, and District. Notices shall be given consideration posted for that position provided that a contact has been made with the personnel office on or before the closing date. No assignment shall be made before the closing date. The District may post the vacancy outside the District simultaneously with the in-house posting. 4.04.5 Voluntary transfers beyond 4.4.5 Transfer requests for the times specified require approval of next school year will be reviewed by site administrators and assignments made. An attempt to contact the Assistant Superintendentteacher will then be made to confirm that the teacher still wants to make the requested transfer. If the teacher accepts the assignment, Human Resources/designeethe transfer will become final. If the assignment is declined, the request for transfer will be removed from the file. Such statement shall include the grade and/or the subject to which the employee desires to be transferred, Human Resources/designeein order of preference. The Assistant Superintendent or designee shall inform the principals of employees who have requested transfer to their school site. Principals shall give preference to District employees in filling any vacancies. Whenever a principal is considering an employee for transfer into the site, the employee shall go through the regular interview process. 4.04.6 18.5.3 A request for transfer shall be considered active for the year for which the transfer is requested unless withdrawn by the applicant. 18.5.4 The applicant’s current position shall not be posted as a voluntary vacancy until he/she formally accepts the transfer. 18.5.5 A transfer request shall not be denied arbitrarily. 4.04.7 If a arbitrarily or capriciously. A unit member may request the written rationale for a voluntary transfer is deniedhis/her not receiving the reassignment. This shall be provided to the unit member within five (5) days of receipt of the request by the District. Additionally, the unit member shall be givengranted a meeting, upon requestrequest with the administrator to discuss the transfer denial. 18.5.6 By October 1st prior to the opening of a new school, the specific reason(s) for District and the denial in writingAssociation agree to negotiate the process by which the vacancies shall be filled. If the parties are unable to agree on a process by February prior to the school opening, the filling of the vacancies shall be governed by the existing terms of this Article.

Voluntary Transfers. 4.04.1 Members (a) Effective February 1, 2001, an appointed teacher must have three (3) years of location seniority in order to voluntarily transfer to another school in the position classification or subject for which he/she is presently qualified and appointed. (b) Teachers seeking voluntary transfers shall receive priority on the basis of their years of location seniority. (c) A teacher who desire has been rated unsatisfactory in the current year shall be ineligible for a voluntary transfer or a right-to-return. (d) Applications for transfer on forms furnished by the Board shall be filed with the Office of Human Resources between February 1 and May 1 preceding the school year in which the transfer is to take effect. When the last day of the filing period falls on a Saturday, Sunday or holiday, the deadline shall be extended to the next workday.
