Waiver by Tenant of Certain Remedies Clause Samples

The "Waiver by Tenant of Certain Remedies" clause limits or eliminates the tenant's ability to pursue specific legal actions or remedies against the landlord in the event of a dispute or breach of the lease. Typically, this clause may prevent the tenant from withholding rent, claiming constructive eviction, or seeking damages for certain landlord defaults, instead requiring the tenant to follow alternative dispute resolution procedures or continue fulfilling lease obligations. Its core practical function is to protect the landlord from disruptive tenant actions and ensure the continuity of rent payments and lease performance, thereby reducing the landlord's risk and potential liability.
