Warehouse. The warehouse operated as part of the Hendersonville Division; however inventory shall be sold at cost to each store within both the Hendersonville Division and the Laurel Park Division.
Warehouse. 1. Among warehouse workers extra work assignments shall be first offered to the most senior warehouse Delivery Stores Clerk at that work site, as defined assuming that he or she is qualified and able to perform the extra work.
2. Extra work assignments will be rotated among all Delivery Stores Clerks at a particular site. If extra work is assigned and performed by a Delivery Stores Clerk, a subsequent extra work assignment will be offered to the next Delivery Stores Clerk at that site, again assuming that he or she is qualified and able to perform the extra work. If extra work is offered but rejected by a Delivery Stores Clerk, he or she will not be eligible for a subsequent extra work assignment until all other Delivery Stores Clerks at that work site have been offered extra work assignments.
Warehouse. Agilent hereby covenants and agrees that it shall construct, or cause to be constructed, a new warehouse building on the Avago Lot in the approximate location identified on the Site Map (the “New Warehouse”). The Parties intend such New Warehouse to replicate for Avago the warehouse facilities located on the Agilent Lot which were utilized by Agilent in connection with the Business prior to the closing of the Business Sale. The New Warehouse shall be constructed utilizing new materials in manner, size (both cubic and square feet) and quality of materials and workmenship consistent with Agilent’s existing warehouse facilities and complying with all applicable laws and zoning and building codes. All costs and expenses relating to the construction of the New Warehouse shall be allocated between the Parties in accordance with the MSA.
Warehouse. Buyer shall also lease from Seller, the Warehouse situated on Parcel # 1303000019 upon the terms and conditions set forth in the attached Commercial Lease which is incorporated by reference herein as Exhibit D2. If Seller has any tenants occupying residences on the Leased Premises, Seller agrees that Buyer shall not be liable to said Tenants for any claims, actions, inactions, negligence, or willful misconduct of Seller and Seller shall retain all liability to the Tenants for claims, actions, inactions, negligence or willful misconduct.
Warehouse. An employee required to work overtime for any period in excess of one hour after the usual hour of ceasing duty shall be paid an allowance as meal money. Provided that such meal allowance shall not be payable to an employee who can reasonably return home for a meal
Warehouse. A. Unless otherwise agreed by ▇▇▇▇▇ Brothers in writing, the warehouse comprising approximately 100,000 square feet and located at ▇▇▇▇ ▇. ▇▇▇▇▇▇▇▇▇ Street, Suite 1, Bluffton, IN 46714 (the “Warehouse”) shall be operated by Warehouseman for the exclusive use and benefit of ▇▇▇▇▇ Brothers. Warehouseman shall promptly notify ▇▇▇▇▇ Brothers of any condition respecting the Warehouse which would prevent or otherwise inhibit its performance of the Services.
▇. ▇▇▇▇▇ Brothers shall have full access to the Warehouse at all times and shall have the right to examine, inspect, inventory and count all or any of its goods. If ▇▇▇▇▇ Brothers desires access outside of normal business hours, ▇▇▇▇▇ Brothers will coordinate access with Warehouseman.
C. Warehouseman shall be responsible for all operating expenses and handling fees in connection with the operation of the Warehouse, except for rent, utilities, dock doors, seals, levelers, restraints , HVAC system and common area charges and real estate taxes unless expenses are due to Warehouseman’s neglect.
D. Warehouseman shall maintain the Warehouse in a good and orderly condition and shall comply with the storage conditions and sanitation and housekeeping standards established by the American Institute of Baking from time to time. Warehouseman shall be responsible for any such related costs to comply. AIB audit cost will be paid by ▇▇▇▇▇ Brothers.
E. Notwithstanding anything to the contrary contained herein, in the event the Federal Food & Drug Administration or any other governmental authority or entity (hereinafter “other agency”) determines that the Warehouse is not a fit space for the storage of ▇▇▇▇▇ Brothers products or food products in general and such condition resulted from some action or omission of Warehouseman, Warehouseman shall either (1) bring the Warehouse into compliance within sixty (60) days of written notice of such determination, or (2) store the ▇▇▇▇▇ Brothers products, which are the subject of this Agreement, at a substitute facility during that portion of the Term in which either the Federal Food &Drug Administration or other agency’s determination of lack of fitness remains in effect. Any charges over and above the charges herein which may be incurred by Warehouseman by virtue of providing substitute storage space shall be the responsibility of Warehouseman. Warehouse. Each year during the first week of September, all delivery personnel, who are interested in overtime work shall sign up. There shall be two overtime lists; one for food service delivery personnel only and one for general delivery personnel. These lists shall place the employees in seniority order and the warehouse coordinator shall have a copy. (On July 1 of each year the two lists shall be combined.) The most senior person with the least amount of hours will be called first and so on down the list in an attempt to equalize the overtime hours. In emergency situations, all delivery personnel may be required to work (i.e., summer work schedule).
