Common use of Work on Weekends and Public Holidays Clause in Contracts

Work on Weekends and Public Holidays. Any hours worked outside the span of ordinary hours (including weekend work) or the hours flexibility provisions, will be paid penalty rates at the rate of time and one half for the first two (2) hours and double time thereafter. Employees must work in excess of 38 ordinary hours averaged over a 4 week period to be entitled to overtime rates. All employees must make themselves available to work a reasonable amount of time outside of ordinary hours. Employees that fail to make themselves available for work outside of ordinary hours may be counselled in accordance with the Disciplinary Procedures of this Agreement. As a general rule, employees will not work Public Holidays gazetted for the State of New South Wales or the locality. An employee that works on a public holiday will be paid double time and a half inclusive of payment for the day calculated on the base rate for hours worked.
