WORKING CONDITIONS. Section 1: Assignment of Bargaining Unit Work If the Board decides to materially alter the scope or content of bargaining unit work, the Employer shall give the Union and affected employees thirty (30) days advance notice, if practicable, but in any event reasonable advance notice, and shall bargain over the impact of such changes on affected employees. It is the intent of the parties that such bargaining shall begin as promptly after notice as possible. In the absence of coordinator-specific professional development, the Board may, in its discretion, elect to compensate employees for regularly scheduled hours missed by reason of attending, or for Saturday hours attending, one or more conferences presented by professional organizations such as AAACE, IACEA, TESOL or ALRC.
Section 3: Materials and Equipment The employer shall endeavor to provide a work space and such materials and equipment as are reasonably necessary for the performance of the employee’s assigned classroom professional duties. Employees shall not be required to produce or officesupply necessary materials or equipment at their own expense. Teachers who believe a student may have special needs will refer the student subject to the building team grievance procedure. The parties agree that a committee made up of an equal number of representatives from both parties shall meet to further refine and make recommendations to the Chancellor regarding the job classifications referred to in this Agreement. The parties recognize that significant differences exist between all the campuses and, therefore, this factor shall be considered as an inherent aspect of the classifications.
Section 6: Working Out of Classification
(a) A coordinator I or II who is directed by his supervisor to substitute continuously for evaluation more than two (2) weeks, for a higher classified coordinator, who is temporarily unable to perform his/her job, shall be paid at the higher pay rate of that classification for as long as the employee performs as a substitute.
(b) A coordinator I or II who contends that he has been performing the essential duties of a higher classified coordinator continuously for more than 60 days may request that the Human Resources Department conduct an audit to determine eligibility his/her proper classification, subject to the grievance procedure. If it is determined that the employee has been working out of classification, he/she shall be entitled to the higher rate of pay from the date the audit was requested.
Section 7: Change in Requirements Where the Board establishes additional requirements for special servicesa bargaining unit position, it shall afford incumbent employees a reasonable period of time to meet the additional requirements for the position.

Any unit member required to provide assistance such as lifting, toileting, or those related to personal hygiene must receive appropriate training so as not to compromise member's health or safety. This training shall be completed prior to performance of such tasks.
9. Telephones will be made available in all classrooms. Use of the phones will be limited to local calls. When working phones are unavailable, unit members may request a cell phone, radio or walkie-talkie from the site administrator. Unit members on school and/or district sponsored field trips may request above mentioned communication device(s) from their site administrator.
10. Any District equipment, including that pupils having special needs receive the attention of special counselorspurchased with grant or gift money, social workersthat is lost, law enforcement personnelstolen, physicians or other professionals. Teachers who believe a student may have special needs will refer the student vandalized shall be reported immediately to the building team principal who will file the appropriate claim form(s) with the District insurance department for evaluation timely processing.
11. Aides, assigned to determine eligibility special education unit members, who are transferred to a new assignment will be expected to remain in their prior assignment until a substitute/replacement aide has been hired and assigned.
12. Guidelines for special servicessharing space between Child Development Services Program and the K-5 Education Program is listed in Appendix 6. This program will be evaluated at the end of the school year with a recommendation to continue, modify, or terminate.

5. Every effort will be made to inform teachers of their teaching assignments by the close of the current school year for the next school year.
6. The parties agree to work together to provide for the orderly and safe operation of school buildings. Teachers shall maintain visibility in corridors and make regular visits to student lavatories to prevent infractions of school rules.
7. Members of the bargaining unit accept responsibility for classroom or officeorder and management. In the event that individual student behavior becomes disruptive to the education of others in the class, bargaining unit members shall receive administrative support.
B. Annual Flexible Work Time Assignments Work time assignment is defined as the daily work start and end times in conformance with the workday included in this Agreement.
1. This provision is intended for scheduling purposes at the high school. However, nothing in this Agreement will prevent the District from implementing a teacher’s assigned classroom is needed during their preparation time, the assignment flexible work schedule in any other District school building in emergency situations.

WORKING CONDITIONS. A. Unless there are special circumstances as determined by the District, effort will be made to maintain state standards for elementary members and Northwest Accreditation Association standards for secondary members.
B. At the request of the Association, class sizes will be reviewed by the District. In the event a member perceives a classroom assignment contains an inequitable number of students, the member may request the principal to review student placement in his/her classroom.

WORKING CONDITIONS. 121.1 Staff deployment is the responsibility of the principal and his/her staff.
21.2 It is understood that teachers are expected to participate in those aspects of student activities which are normal extensions of the classroom program. Also, it is understood that some parameters for extracurricular activities are necessary in order to ensure both the quality of classroom instruction and a viable workload for teachers. The extent of school involvement in extracurricular activities must be determined by the principal and his/her staff. Teachers who have chosen to undertake a specific extracurricular activity shall be committed to that activity for its duration in that
21.3 A teacher not in receipt of any administrative allowances will not be assigned duties in excess of 30 hours per week, averaged over the school year. WORKING CONDITIONS. 1Section A. The parties recognize that the availability of quality school facilities and equipment for both student and teacher is desirable. The Board shall supply BOARD agrees to provide a work place with physical facilities which are conducive to a quality educational program. Section B. 2Section C. The BOARD will provide for each teacher serviceable desks and chairs, closet space, lock- able storage areas, and storage space for instructional materials and computers with access to the Inter- net and a secure printer. The Board BOARD shall provide first aid supplies in each building. Each teacher will be provided a universal precautions kit and the teacher will assume the responsibility for replacing used items from building stock.
Section D. The BOARD recognizes that it is desirable to provide special service teachers the needed privacy to carry out their responsibilities with individuals or groups of students.
Section E. The BOARD shall make availableavailable in each school: lunch room/lounge and restroom facilities exclusively for adult use. Where possible, another room, appropriately furnished, shall be reserved exclu- sively for use as a faculty lounge/lunchroom. The BOARD shall make available in each school, adequate lunchroomspace which shall be reserved as a work area, and rest room which shall contain adequate equipment to aid in the preparation of instructional materials (e.g., three (3) hole punch, computers, printers, copy machine).
Section F. Every school shall have available for teacher use telephones and telephone lines on which long distance calls can be made. These phones shall be installed in locations other than administrative offices. Every school shall have at least one (1) telephone available for teachers' use where privacy may be insured.
Section G. Parking facilities exclusively shall be made available to teachers and maintained (and repaired) for employee their use separate from student parking. Conditions permitting, teacher parking lots will be plowed and salted before the teacher workday to prevent accidents. The BOARD reserves the right to free a portion of parking locations for election day or other emergency use. Except as otherwise provided below, or in an emergency situation, a teacher will not be assigned more than one (1) hour of such substituting per day nor will a teacher be paid for more than a total of one (1) hour per day of such substituting. Elementary classroom teachers who miss one or more scheduled planning periods in one workday because of teacher absences will be determined by administration first by seeking compensated for each scheduled planning period missed. If a volunteersecondary teacher is also assigned to substitute during his/her scheduled planning time, then on he/she will also be compensated for said missed planning time. The employee must participate in an approved program. This provision shall not be utilized more than twice per member.
F. In the event that a child with an ongoing or chronic communicable disease is allowed, by policy or law, to attend school, all employees having contact with respect the student shall be notified in advance of the child's placement and/or return to school, to the maintenance of control and discipline.

WORKING CONDITIONS. 1Section 9:01 Call Out – Compensation
(a) Twelve-month employees who receive holiday pay for school holidays listed in the Agreement (e.g. New Year’s Day, ▇▇▇▇▇▇ ▇▇▇▇▇▇ ▇▇▇▇ Day) and who are called out to their worksites to perform work on such holidays will be paid double time for all time worked in addition to their holiday pay.
(b) Twelve-month employees who are not on duty and are called out to their worksites to perform work on a non-holiday (e.g. after regular working hours, weekends, scheduled day off) shall be compensated in accordance with the Fair Labor Standards Act, but shall be guaranteed a two (2) hour minimum.
(c) Custodians responsible for turning off alarms shall be compensated in accordance with the FLSA but shall not be guaranteed a minimum.
Section 9:02 Duty Schedule Bargaining Unit members shall be assigned a schedule of specific duties to be performed on a routine basis.
Section 9:03 Employee Training Employees shall be trained to perform duties which are new to them. Training shall take place during regular working hours. If not, employees will be compensated for training time spent outside of regular working hours.

B. At the request of the Association, class sizes will be reviewed by the District. In the event a member perceives a classroom assignment contains an inequitable number of students, the member may request the principal to review student placement in his/her classroom.

3.5.1 During a faculty member’s classroom periods, identify and regulate exclusive of breaks, he/she will not conduct outside business or receive or place outside phone calls except in the case of a serious personal emergency. When a message indicating a serious personal emergency is received, all reasonable efforts will be made to deliver the extent possible adequate paved off-street staff parking facilities. 5.2 Each employee must read the State Board shall supply document, Supporting Student Behavior: Standards for the Emergency Use of Seclusion and maintain textsRestraint. Staff should use proactive and effective strategies to reduce or eliminate the need for the seclusion or restraint of students. Seclusion and restraint should be used only in an emergency and require diligent assessment, library facilitiesmonitoring, maps and globes, laboratory equipment, audio-visual equipment, art supplies, athletic equipment, current databases, copiersdocumentation, and computers reporting by personnel. Each employee must read the Department of Education guidelines on seclusion and restraint, and be trained in strategies to use prior to using physical force. 5.3 Employees shall be reimbursed at the current IRS rate for any mileage while conducting school business in their own vehicles. Any mileage accumulated that is in excess of traveling to the normal worksite will support all software be reimbursed for Professional Development.
5.4 The BOARD shall provide without cost to the employee first aid kits which may include rubber gloves, goggles, ▇▇▇▇▇▇▇, and applications owned emergency first aid items. Additional safety equipment may be requested of the BOARD as the situations may deem necessary.
5.5 The BOARD may provide in-service training sessions for employees. Such sessions shall be held at reasonable times and employees may provide input on in-service topics.
5.6 Any training/certification required by law or subscribed BOARD policy to perform an employee’s duties will be provided, fully paid, by the district, printers, support, training, . This provision excludes any reimbursement for elective coursework and similar materials and tools of the teaching professioncollege coursework that may become required due to future changes in any state or federal law.

7. Teachers may request that pupils having special needs receive the attention of special counselors, social workers, law enforcement personnel, physicians or other professionals. Teachers who believe a student may have special needs will refer the student to the building team for evaluation to determine eligibility for special services.

WORKING CONDITIONS. 1Section A. The parties recognize that the availability of quality school facilities and equipment for both student and teacher is desirable. The Board shall supply BOARD agrees to provide a workplace with physical facilities which are conducive to a quality educational program. This includes classrooms that are cleaned and maintain maintained appropriately.
Section B. The BOARD recognizes that appropriate textbooks, teacher texts/manuals, library reference facilities, maps and maps, globes, laboratory equipment, audio-audio visual equipment, art supplies, athletic equipment, current databasesperiodicals, copiersstandardized tests, and computers that will support all software and applications owned or subscribed to by the district, printers, support, training, questionnaires and similar instructional materials and are the tools of the teaching professionprofession and the BOARD shall make every effort at all times to keep the schools reasonably and properly equipped with such material. The BOARD further recognizes the value of teacher participation in the selection and use of instructional materials and will confer from time to time with the ASSOCIATION for the purpose of improving the methods of selection and use of such educational tools. The BOARD will attempt to implement all joint decisions made by its representative and the ASSOCIATION, however, the BOARD reserves the right to approve final purchase and selection of such instructional materials.
2Section C. The BOARD will provide for each teacher serviceable desks and chairs, closet space, lockable storage areas, and storage space for instructional materials and computers with access to the Internet and a secure printer. The Board BOARD shall provide first aid supplies in each building. Each teacher will be provided a universal precautions kit and the teacher will assume the responsibility for replacing used items from building stock.
Section D. The BOARD recognizes that it is desirable to provide special service teachers the needed privacy to carry out their responsibilities with individuals or groups of students.
Section E. The BOARD shall make availableavailable in each school: lunchroom/lounge and restroom facilities exclusively for adult use. Where possible, another room, appropriately furnished, shall be reserved exclusively for use as a faculty lounge/lunchroom. The BOARD shall make available in each school, adequate lunchroomspace which shall be reserved as a work area, and rest room which shall contain adequate equipment to aid in the preparation of instructional materials (e.g., three (3) hole punch, computers, printers, copy machine).
Section F. Parking facilities exclusively shall be made available to teachers and maintained (and repaired) for employee their use separate from student parking. Conditions permitting, teacher parking lots will be plowed and salted before the teacher workday to prevent accidents. The BOARD reserves the right to free a portion of parking locations for election day or other emergency use. Upon request from Where two (2) parking lots exist, one (1) shall be available for teachers and the other for students.

In such emergency cases when a regular teacher has been assigned to substitute in another teacher’s assignment during a conference/preparation period, or a period that would occur beyond a teacher’s normal teaching day, the teacher shall be reimbursed at the rate established in Appendix B of this Agreement. 2. The Board shall make available, in each school, adequate lunchroom, and rest room facilities exclusively for employee usehealthful working conditions. Upon request from an employeeof the Association, the administration City or a department will identify an appropriate private space other than meet with the Association to discuss and address safety concerns relating to the facilities where Unit Employees are assigned to work. Where the Unit Employee has a bathroomgood faith belief that a work assignment presents health and safety risks outside those normally associated with the work, which can he/she may refuse to begin or continue a work assignment. When in such a case a Unit Employee declines to begin or continue a work assignment, he/she shall notify his/her in-house safety officer of the situation. The in-house safety officer shall promptly investigate the complaint. While the Unit Employee is awaiting the arrival of the in-house officer and until the officer has made his/her determination, the Unit Employee shall not be lockedrequired to perform the disputed assignment. Unit Employees shall not be subject to discipline or retaliation for exercising any right under the OSHA act.
Section 5-2 Training & Career Development The City of Tempe supports the development of career counseling and various programs of training, retraining, mentoring, and make accommodations in the employee’s daily schedule as needed career development for Unit Employees, to support their lactation needs. The use of tobacco or E-cigarettes is prohibited in all buildingsbe coordinated between Human Resources, on all groundsCity departments, and in all school owned vehicles. Overtime will be paid in accordance with the FLSA. Management reserves the right to schedule mandatory meetings as needed. The Parties agree to jointly advocate for the inclusion of public employees in any future local, state, or federal legislation providing for training and retraining programs. Recognizing that proper training and mentoring of City employees promotes efficient and cost- effective public service, the parties agree to place these issues on the agenda of the joint Labor- Management Committees established by this Agreement. Recommendations may include but not be limited to training for promotional opportunities, creation of career counseling programs, and work-related certification. Decisions shall maintain the lounges in a satisfactory conditionbe made by mutual agreement, except for routine custodial maintenancesubject to approval as required by applicable law.
