Zero Liability does not apply to Mastercard payment cards that are used for commercial purposes or anonymous prepaid cards (until such time as the identity of the cardholder has been registered with us). In the event that Mastercard Zero Liability does not apply, if you notify us within two (2) business days after you learn of any unauthorized transactions, you can lose no more than $50.00 if someone used your Card without your permission. If you do not notify us within two (2) business days after you learn of the loss or theft of your Card and we can prove that we could have stopped someone from using your Card without your permission if you had promptly notified us, you could lose as much as $500.00.

If a good reason (such as a long trip or a hospital stay) kept you from telling us, we will extend the time periods. Also, if you become aware of and/or your statement shows transactions you did not make, notify us at once following the procedures stated in Section XVIII (Your Right to Dispute Errors). If you do not notify us within sixty (60) days after you become aware of the transaction and/or after the statement was made available to you, you may not get back any value you lost after the sixty (60) days if we can prove that we could have stopped someone from taking the value if you had notified us in time. You will not be liable for unauthorized use that occurs after you notify us of the loss, theft or unauthorized use of your Debit Card or Access Code(s). You also agree to cooperate completely with us and the Bank in attempts to recover funds from unauthorized users and to assist in their prosecution. The Bank may issue replacement Debit Card(s) or Access Code(s), but only after you have provided such proof and security or indemnification as the Bank may require. In addition, you acknowledge that the Bank may have to deactivate your Debit Card(s) to prevent future losses. If you share your Debit Card(s) or Access Code(s) with another person, use of your Debit Card by that person may be considered as authorized. If you authorize another person to use your Debit Card or Access Code(s), you agree that you will be liable for all transactions arising from use of the Debit Card or Access Code(s) by such person except as otherwise set forth in this Agreement. In all cases, our liability for an unauthorized transaction is limited to reimbursing you for the face amount of the unauthorized transaction and any corresponding fees, except as otherwise required by applicable law. A transaction is unauthorized if it is not initiated by you, you did not give permission to make the transaction or you do not benefit from the transaction in any way.

You understand that these applications and services do not provide the same protections from fraud or other misapplication of funds as traditional direct banking services. If we transfer any funds as directed by you or anyone you authorize to the application or third-party service provider such transfer(s) shall in all respects be an authorized transaction and we will have no further obligation or liability if you have used reasonable care in protecting your Card from loss the application or theft and you have promptly reported provider then transfers the funds to us when you knew a fraudster or the funds are otherwise misapplied. Additionally, your liability with respect to unauthorized transactions may be greater than the above zero ($0) liability limit, to the extent allowed under applicable law, if: (1) we determine the unauthorized transaction was a result of gross negligence or fraud on your part; (2) you fail to provide us with a statement or affidavit of your claim within the time requested; (3) we determine the transaction was not “unauthorized” as much as $500.00defined below; or (4) you fail to report the loss, theft, or unauthorized use of your debit card of card number within a reasonable period of time. A reasonable period of time will be determined by the Credit Union in its sole discretion, but in no event will it be shorter than the time periods stated in the Error Resolution Section below. A transaction is considered “unauthorized” if it is initiated by someone other than you (the cardholder) without your actual or apparent authority, and you receive no benefit from the transaction. A transaction is not considered “unauthorized” if: (1) you furnish the card, card 35 number, or other identifying information to another person and give that person express or implied authority to perform one or more transactions and the person then exceeds that authority; or (2) for any other reason the Credit Union concludes the facts and circumstances do not reasonably support a claim of unauthorized use. In any case, to minimize your potential liability you should notify us of any unauthorized use no later than sixty (60) days after your statement was mailed to you.

In Case of Errors or Questions About Transactions This section applies only to transactions covered by this Agreement. You may call at ▇▇▇.▇▇▇.▇▇▇▇ or write Us at DFCU Financial PO Box 6048, Dearborn, MI 48126-6048 as soon as You can, if You think Your statement is wrong or if You need more information about a transfer covered by this Agreement which is listed on the statement. We must hear from You no later than 60 days after We sent the FIRST statement on which the problem or error appeared. Tell Us Your name and account number (if any). Describe the error or transfer You are unsure about, and explain as clearly as You can why You believe it is an error and why You need more information. Tell Us the dollar amount of the suspected error. If You tell Us orally, We may require that You send Us Your complaint or question in writing so that We receive it within 10 business days. We will determine whether an error occurred within 10 business days after We hear from You and will correct any error promptly. If We need more time, however, We may take up to 45 days to investigate Your complaint or question. If We decide to do this, We will provisionally credit Your account within 10 business days for the amount You think is in error, so that You will have the use of the money during the time it takes Us to complete Our investigation. If We ask You to put Your complaint or question in writing and We do not receive it within 10 business days, We are not required to provisionally credit Your account. When the investigation is completed, We will make any necessary or appropriate adjustments to Your account. We will tell You the results within 3 business days after completing Our investigation. If We decide that there was no error or the error was different than You described, We will send You a written explanation. You may ask for copies of the documents that We used in Our investigation by contacting Us at the phone number or address listed above. This Agreement will stay in effect until it is changed or terminated. We have the right to terminate this Agreement at any time. We will ordinarily send You notice of any termination, but We are not required to do so unless applicable law requires such notice. Once We terminate this Agreement, no further or pending transfers will be made, including but not limited to any transfers scheduled in advance or any preauthorized recurring transfers. We may routinely terminate OnLine Banking service for members that have not used the service within the first 30 days after activation or if the service has been inactive for 180 days. We also have the right to make changes to this Agreement at any time. Your use of these services after any such change indicates that You agree with the changes or additions made to this Agreement. We will comply with any notice requirements under applicable law for such changes. If applicable law does not specify any notice requirements for the change, We will decide what kind of notice (if any) We will give You and the method of providing any such notice. You may terminate this Agreement at any time by notifying Us in writing. However any instructions from You to make transfers will continue in effect until We have received Your written notice of termination and have had a reasonable opportunity to act upon it. Once We have acted upon Your notice, no further or pending transfers will be made, including but not limited to any transfers scheduled in advance or any preauthorized recurring transfers. You are not permitted to alter or amend this Agreement or any related document without Our express written consent. Any attempt to do so will be void and unenforceable.

If your Card is registered and you notify us within two (2) business days after you learn of the loss or theft of your Card or Card Account login information, your losses will be limited to $50 or such other amount provided by law, if your Card Account suffers losses of at least that amount due to unauthorized usage. If you DO NOT tell us within two (2) business days after you learn of the loss or theft of your Registered Temporary or Personalized Card or your Card Account Access Information, and you suffer losses due to unauthorized usage, then you may be liable up to $500, or such other amount provided by law, if such losses could have been prevented had you timely notified us. Also, if your statement shows transfers you did not make, including those made with a Registered Temporary Card, Personalized Card, code or other means, notify us at once. If you do not notify us within 60 days from the earlier of the date you electronically access your Card Account, if the unauthorized transfer could be viewed in your electronic history, or the date we sent the FIRST written history on which the unauthorized transfer appeared, you may not get back any money you lost after the 60 days if we can prove that we could have stopped someone from using your Card without your permission taking the money if you had promptly timely notified us. If a good reason (such as a long trip or a hospital stay) kept you from telling us, we will extend the time periods, in our sole discretion or as required by law or rule. If your Card has been lost or stolen, once notified, we will close your Card Account to keep losses down and will send a replacement card. There is a fee for replacing your Card.
