Liability for Unauthorized Transactions. You are responsible for all transfers you authorize using Energy One’s Online Bank service under this Agreement. If you permit other persons to use your Energy One Online Bank password, you are responsible for any transactions they authorize or conduct on any of your accounts. You will be liable for unauthorized access to accounts thru Online Bank to the extent allowed by applicable federal and state law. You must tell us at once if you believe anyone has used your Energy One’s Online Bank password, log on id, member number and accessed your accounts without your authority. Telephoning us is the best way of keeping your possible losses down. You could lose all the money in your account (plus your maximum line of credit) without your permission. If you do not tell us within two (2) business days after you learn of the unauthorized use of your account or password, and we can prove that we could have stopped someone from accessing your account without your permission if you had told us, you could lose as much as $500. If your statement shows Energy One’s Online Bank transfers that you did not make, tell us at once. If you do not tell us within sixty (60) days after the statement was made available to you, you may be liable for the full amount of the loss if we can prove that we could have stopped someone from making the unauthorized EFT transaction. 1. If you contact us within two (2) Business Days of the loss or your discovery of the loss, you can lose no more than $50.00 if someone illegally gained access to and used your password without your permission.
2. If you do NOT tell us within two (2) Business Days after you learn of the loss or theft of your password, and we can prove we could have stopped someone from using your password without your permission if you had told us, you could lose as much as $500.00.
3. Also, if your monthly statement shows transactions that you did not make and you do not contact us within sixty (60) days after the statement was mailed (or electronically submitted) to you, you may not get back any money lost after the sixty (60) days if we can prove that you’re contacting us would have prevented the losses.
4. If a good reason, such as a trip or an extended hospital stay, kept you from telling us, we will extend the above time periods.

Liability for Unauthorized Transactions. You are liable for all unauthorized card transactions, whether they are effected as a result of the unauthorized use of the card, the PIN and/or the TBS Access Code or otherwise. Notwithstanding the foregoing, your liability for all unauthorized transactions on your card which are effected prior to you notifying us shall be limited to US$100.00 provided:-
(a) you have fully complied with clauses 9.1 and 9.2;
(b) you assist in the investigations and recovery; and
(c) we are satisfied that such unauthorized card transactions are not due to your negligence and that you have not acted fraudulently.
Liability for Unauthorized Transactions. 5.1 The Bank must be notified immediately of any lost or stolen Card or any unauthorised use of the Card and the circumstances thereof through the Hotline (the “Notification”), Cardmember will not be liable for card-present unauthorised transactions which require PIN verification if Cardmember has not:
(a) acted fraudulently or with gross negligence;
(b) delayed in notifying the Bank as soon as reasonably practical after having discovered the loss or unauthorized use of the Card;
(c) voluntarily disclosed the PIN to another person; or
(d) recorded the PIN on the card or anything kept in close proximity with your Card. Cardmember will not be liable for card-present unauthorised transactions which require signature verification or the use of a contactless card, provided you have not:
(a) acted fraudulently or with gross negligence;
(b) delayed in notifying the Bank as soon as reasonably practicable after having discovered the loss or unauthorised use of the Card;
(c) left the Card or an item containing the card unattended in places visible and accessible to others. Cardmemebers shall exercise due care in safeguarding the Credit Card even at the Cardmember’s place of residence; or
(d) voluntarily allowed another person to use the Card.
5.2 The Cardmember may request that replacement card be issued to the Cardmember following loss or theft of the Card. The Bank shall be under no obligation to issue a replacement card and, the issuance of any replacement card is subject to such card replacement fee and execution of card replacement related documentations as the Bank deems fit and appropriate.
5.3 In consideration of the Bank issuing the Cardmember a replacement of the original card, the Cardmember agrees to hold the Bank free from liability and shall indemnify the Bank from and against all claims, demands, losses, damage, cost, charges, and expenses which the Bank may incur and be liable in the event the original card is used or dealt with in any way now or at any future time or in consequence of the Bank issuing the Cardmember the replacement card at the Cardmember’s request for which the Bank may debit the Cardmember’s account and/or set off such sum from any account standing in credit in the Cardmember’s name.
Liability for Unauthorized Transactions. 9.1 To protect yourself from unauthorized activity in your Account, you should regularly log into your Account and review your transaction history and Account statements, and you should never share your Security Credentials or any one-time passcodes with anyone. Both your transaction history and Account statements are available in the App and you may contact Customer Care to assist you in accessing a copy of your transaction history and Account statements. Transaction receipts can also be found in the App. We will notify you of each transaction through the App. You must have provided us with at least one valid method of communication to use the App and it is your responsibility to ensure that your communication preferences are kept up to date. Please review these transaction notifications to ensure that you authorized each transaction and that it was accurately completed.
9.2 By law, certain protections are afforded to you in connection with unauthorized activity in your Account. We will provide certain protections to you as long as you cooperate with us and follow the procedures described below.
9.3 What is an Unauthorized Transaction? An “Unauthorized Transaction” occurs when money is sent from your Account that you did not authorize and that did not benefit you. For example, if someone steals or fraudulently obtains your Security Credentials (or the Security Credentials of your Authorized Recipient), uses the Security Credentials to access funds in your Account, and sends a payment using those funds, an Unauthorized transaction has occurred.
9.4 What is not an Unauthorized Transaction? It is not an Unauthorized transaction if you grant authority to someone to use your Account by giving them your login information and they exceed the authority you gave them. You are responsible for transactions made in this situation.
