THIS BLUHAWK DEVELOPMENT AGREEMENT (this "Agreement"), is made and entered into this day of April, 2013 (the "Effective Date") by and between the CITY OF OVERLAND PARK, KANSAS, a municipal corporation duly organized under the laws of the State of Kansas (the "City") and DMP 159/69 LLC, a Kansas limited liability company, KAP 159/69 LLC, a Kansas limited liability company, LBK 159/69 LLC, a Kansas limited liability company, and JEP 159/69 LLC, a Kansas limited liability company (collectively, the "Developer").
