New Century Energy Corporation and Aquatic Cellulose International Corporation (together, the "New Century Group") and Strong Petroleum Group,Inc. The term of the Development Agreement has, as of September 21, 2006, run. This memorandum represents an acknowledgement that: (1) Strong did not earn any interest in the Contract Area or any personal property, equipment and fixtures associated with the oil and gas operations on the Contract Area; and (2) given the Development Agreement's term is over, Strong is not capable of earning any interest in the future under that Development Agreement.

Staff advise that the proposal is consistent with the overall intent of the MPS to support the development of new subdivisions which include new or extended public streets, for low-density residential use, where central services are available. The density and housing form of this proposal are aligned with the Herring Cove community village character, and the site design includes features that support environmental protection. Based on the policy review, the technical studies, and the public engagement outcomes, staff recommend that the Halifax and West Community Council approve the proposed development agreement.
