Subsequently, a "business transaction agreement" was concluded; it contained both a choice of law clause in favour of Swiss law as well as a jurisdiction clause in favour of the courts in St. Gallen (CH). The claimant brought an action before the Bezirksgericht of St. Gallen (CH) for payment of a certain money sum. The defendant challenged the jurisdiction of the court seised. The court granted the challenge and referred the matter to the Handelsgericht of the Canton of St. Gallen (CH). It held that it had jurisdiction. The defendant lodged an appeal to the Bundesgericht (CH). The Bundesgericht (CH) dismisses the appeal. The jurisdiction agreement must be assessed according to Article 17 Lugano Convention.
